II. AND BE IT ENACTED, That the trustees of the poor of the several counties in which this act
is intended to operate, are hereby authorised and empowered, if in their judgment they shall think
it most advantageous for the interest of the county, and for the accommodation of the poor of said
county, to contract with any person or persons for the maintenance of said poor by the year, the
said person or persons giving bond, with security, to the trustees of the poor of said county, in such
penalty as said trustees may require, for the faithful performance of the conditions and obligations
thereof.

LXXXIV.

An ACT to authorise the drawing of a Lottery in Frederick-Town
for the purpose of paving Market-Street in said Town.

BE IT ENACTED, by the General Assembly of Maryland, That it shall and may be lawful for Roger
Nelson, Seth Clark, Richard Brooke, Jacob Medtart, Henry Steiner, John M'Pherson, Michael
Baltzell, George Frisler, Henry Bantz, Casper Mantz, Laurence Brengle, Stephen Stoner, John
Bayly and Frederick Heisely, or a majority of them, to propose a scheme of a lottery or lotteries
for raising a sum of money, not exceeding eight thousand dollars, and sell and dispose of the tickets
in said lottery, and they are hereby authorised to draw said lottery; provided, that the said Roger
Nelson, Seth Clark, Richard Brooke, Jacob Medtart, Henry Steiner, John M'Pherson, Michael
Baltzell, George Frisler, Henry Bantz, Casper Mantz, Laurence Brengle, Stephen Stoner, John
Bayly" and Frederick Heisely, or such majority of them as shall undertake to act under this law,
shall, before the sale or disposal of any ticket or tickets in said lottery or lotteries, give their bond
to the state of Maryland, in the penalty of twelve thousand dollars, conditioned that they will well
and truly apply so much money arising therefrom, within six months after the drawing of said lottery
or lotteries shall be completed, as will satisfy the fortunate adventurers for prizes drawn by them,
and after deducting the necessary expenses incurred in said lottery shall, within two years from the
time the drawing of said lottery shall be completed, apply the money raised by such lottery or lot-
teries for the purpose of paving Market-street in Frederick-town aforesaid.

II. AND BE IT ENACTED, That it shall be the duty of the said commissioners, before they act as
such, to lodge the bond made and entered into as aforesaid in the office of the clerk of Frederick
county court, there to be recorded, and upon such bond, or any office copy thereof, suit or suits may
be instituted against the obligors therein, or any of them, or their legal representatives, for any
breach or non-compliance with the condition of the same.

CHAP. LXXXVI.

Passed 6th of
Jan. 1810.

A Supplement to an Act, entitled, An Act to lay out a certain Road
in Baltimore County.

WHEREAS John Weston, by his petition to this general assembly, hath represented, that the
road as laid down by the commissioners appointed under the act to which this is a supplement,
is very injurious to his farm, and the valuation of damages made by said commissioners not nearly
adequate to the injury he hath sustained, and prays that other commissioners may be appointed to
revalue the same; therefore,

II. BE IT ENACTED, by the General Assembly of Maryland, That Robert Porter, John Murray and
Benjamin Gatch, be and they are hereby appointed commissioners to value the damages sustained by
the said John Weston by reason of the aforesaid road passing through his land, and they, or a majo-
rity of them, are hereby authorised to meet upon the premises on or before the first day of May
next, and after being duly qualified before some justice of the peace, truly and impartially to esti-
mate the damages sustained by the said John Weston by reason of the said road running through his
farm, they shall proceed to value the same, taking into their consideration the advantages and disad-
vantages, if any, and such valuation shall be final and conclusive.

III. AND BE IT ENACTED, That as soon as the said road shall be laid out and opened, and the
valuation herein directed to be made shall have taken place, the same shall be deemed and taken to
be a public road, and kept in repair as other public roads in said county are, any thing in the act to
which this is a supplement to the contrary notwithstanding.
