38-B. One-half of the expense of such alterations, changes,
relocation and/or opening, including damages to adjacent prop-
erty, shall be paid by such railroad and one-half by the State
Roads Commission. When two or more railroads use such
crossings, each shall bear its proper proportion of the railroad's
share of the expense, such proportion to be determined by the
State Roads Commission.
The Mayor and City Council of Cumberland is authorized
and empowered to advance to the State Roads Commission out
of any surplus now in its hands from its General Improvement
Bond Issue of 1920, or from any other surplus now in its hands,
or from any money which may now be owed it, such sum as
may be necessary, not exceeding one-half of the amount which
the State Roads Commission will be required to pay as its pro-
portionate share, for the purpose of altering, in the manner
provided in Section 38-A of this Act, the railroad grade cross-
ing at the intersection of Baltimore Street with the Baltimore
and Ohio Railroad Company's tracks in the City of Cumber-
land, Allegany County; and any amount so advanced shall be
repaid without interest to said Mayor and City Council of
Cumberland within a period of ten (10) years by the State
Roads Commission at such time and in such amounts as said
State Roads Commission in its discretion may consider avail-
able for that purpose out of funds raised by this Act.
38-C. The expense of removing, relaying or relocating any
municipal or county water or sewer pipes or other municipal
or county pipes, conduits or subways, shall be borne by the
railroads and the State Roads Commission as provided in
Section 38-B. Plans under which these changes are to be made
shall be approved by the owners of the structures involved.
38-D. Where the order of said State Roads Commission
shall require changes in, or the removal of the property or
constructions of any telegraph, telephone, gas, electric, light-
ing, power, water, oil, pipe lines or other company or corpora-
tion, co-partnership or individual, they shall move or change
the grade or location of their property or constructions in con-
formity with the order of the Commission. The cost of chang-
ing, removing or constructing the said lines shall be paid by the
railroads and the State Roads Commission as provided in
Section 38-B. Plans under which these changes are to be made
shall be approved by the owners of the structures involved.
