the public health, said disposition to be determined by the
Commissioners of Delmar. Any violation of the provisions of
this Section shall be a misdemeanor, punishable under Section
12, of this Act.

SEC. 5. And be it further enacted, that before, any sewer
construction is done upon any private property within the cor-
porate limits of the town of Delmar, the person, firm or cor-
poration doing the same shall first obtain a permit from said
Commissioners of Delmar, and pay therefor such reasonable
sum as the Commissioners of Delmar may prescribe. Such
work shall be done under and pursuant to such rules, regulations
and requirements as the Commissioners of Delmar may, from
time to time, formulate, and subject to such inspection as may
be deemed necessary. No connection of any kind shall be made
with any sewer constructed or maintained by said Commissioners

of Delmar without a permit, and under such conditions as
said Commissioners of Delmar may authorize. Said Commis-
sioners of Delmar shall have the right of entry at reasonable
hours to all buildings and premises having any connection with
the sewerage system under its jurisdiction, and may order and
require such changes in all sewer connections as they may
deem necessary to eliminate improper use of sewers. No private
or semi-public sewerage installation intended for the use of
two or more buildings or premises shall be constructed in said
town of Delmar without the person, firm or corporation doing
the work having first obtained a permit from said Commission-
ers of Delmar and paid a reasonable charge therefor, and
such plant shall then be installed, maintained and operated
under such rules and regulations as said Commissioners of Del-
mar may require or devise. Any violation of any of the pro-
visions of this Section shall be a misdemeanor, punishable under
Section 12, of this Act.

SEC. 6. And be it further enacted, that all individuals, firms
or corporations lawfully having buildings, structures, works,
conduits, mains, piles or other physical obstructions in, over
or under the public lanes, avenues, streets, alleys or highways
in the town of Delmar, which shall block or impede the progress
of the sewers of the Commissioners of Delmar, when in progress
of construction and establishment, shall, upon reasonable notice
from said Commissioners of Delmar, promptly so shift, adjust,
accommodate or remove the same, as to fully meet the exi-
gencies occasioning such notice; and should the exigencies of
said work in any case involve a taking, in the constitutional
sense, of the franchise or right in the exercise of which such
obstruction had its origin, or of the property subject thereto,
the Commissioners of Delmar shall be empowered to secure the
