from assessments upon sidewalks, curbs, gutters and street im-
provements which last said funds shall be kept as a separate
account and fund and no part thereof shall ever be used for
any other purpose than to liquidate the certificates of indebt-
edness, and interest thereon, issued for sidewalks, curbs, gut-
ters and roadbed and street improvements, which certificates
when paid, shall be cancelled and in addition to being properly
kept and filed among the papers of said town, a copy of which
certificates thus cancelled shall be entered upon a separate book
kept for the purpose aforesaid; and should the treasurer of
said town ever divert the use of any of said sidewalk or street
improvement fund, he shall upon conviction, be fined not more
than $1, 000 or imprisoned for a term not exceeding two years,
or both fined and imprisoned in the discretion of the court.

CHAPTER 164.

AN ACT to repeal and re-enact, with amendments, Section
319 of the Code of Local Laws of Prince George's County,
Maryland, codified by Marion Duckett and Thomas Van
Clagett, requiring the Mayor and Common Council of
Hyattsville to publish in a newspaper of the town of Hyatts-
ville, or mail to each citizen thereof, before each regular
election a copy of a statement showing the financial condi-
tion of said town.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That Section 319 of the Code of Local Laws of
Prince George's County, Maryland, codified by Marion Duckett
and Thomas Van Clagett, be and the same is hereby repealed
and re-enacted with amendments, so as to read as follows:

Section 319. It shall be the duty of the Mayor and Com-
mon Council of Hyattsville, at least ten days before each regu-
lar election, to have prepared, in pamphlet form, a detailed
statement of the financial condition of the town, including; re-

ceipts and expenses of all kinds whatsoever, for the preceding
year. At least ten days before such election it shall cause the
same to be published in one newspaper of the town of Hyatts-
ville, or cause a copy thereof to be mailed, postpaid, to each
citizen of said town.
