in said respective advertisements, for bonds issued under the
provisions of this Act, under such regulations as may be made
in the discretion of said County Commissioners or a majority
of them; and the accrued interest between the date of the bonds
and the time of the sale and delivery and payment therefor shall
be adjusted with the purchasers thereof under such regulations
as may be made in the discretion of said County Commission-
ers or a majority of them; and upon the day mentioned in said
advertisement as the day fixed for opening the bids for the pro-
posals thereby called for, the said County Commissioners shall
open said sealed bids; and on the opening of said sealed pro-
posals, as many of said bonds as have been bid for shall be
awarded by the said County Commissioners or a majority of
them, to the highest responsible bidder or bidders therefor for
cash, at not less than the par value of said bonds; and when
two or more bidders have made the same bid, and such bid is
the highest, and the bonds so bid for by the highest responsible
bidders are in excess of the whole amount of the bonds offered
for sale, such bonds shall be awarded to the highest responsible
bidders bidding the same price, in a ratable proportion; and if
any of said bonds so offered for sale are not bid for, or if any
insufficient price be bid for them, they may subsequently be
disposed of by the said The County Commissioners of Carroll
County or a majority of them, at private sale, upon the best
terms they can obtain for them, provided that none of said bonds
shall be sold for less than par and interest.

SEC. 9. And be it further enacted, That said Board of Edu-
cation shall award the work of erecting said new public school
buildings, designated in Section 2 of this Act, and equipping
the same with heating plant and water fixtures, and shall award
the contracts for enlargement, improvement or repair of such
school buildings, designated in Section 2 hereof, as the said
Board of Education shall determine upon to be enlarged, im-
proved or repaired, after the said Board of Education shall
have advertised for bids therefor, and the said Board of Edu-
cation shall require the successful bidders or contractors to whom
the work is awarded to each execute a contract in writing for
the faithful performance of the same, and, in the said contract,
the said builders or contractors shall agree as part of said con-
tract to pay for all labor employed and all materials furnished
and used in the erection and equipping of said new public
school buildings, and in the enlargement, improvement, or re-
pair of old public school buildings, and shall give bond for the
faithful performance of the contract, including the payment for
all labor and materials, in the penal sum of fifteen (15%) per
cent, of the contract price; such bond to be approved by the
said Board of Education, and said bond shall be given to the
State of Maryland as obligee, and shall be subject to suit by the
