36. Any person or persons violating any of the provisions
of Section 34 shall be deemed guilty of a misdemeanor and
upon conviction before any Justice of the Peace of the Coun-
ty or City where the offense was committed, shall be
fined not less than Twenty-five Dollars ($25. 00) nor more
than One Hundred Dollars ($100. 00) and costs for each
and every offense. Any person who fails to pay the fine so
imposed shall stand committed to jail until the fine and costs
shall have been paid, but such imprisonment shall not exceed
sixty days for any one offense.

WATER FOWL AND MIGRATORY BIRDS.
USE OF BOATS PROHIBITED. BLINDS.

37. It shall be unlawful to hunt or take, in any manner,
or by any means whatever, the nest or eggs of any migratory
birds, except in the manner and by the means described by reg-
ulations duly adopted by the Secretary of Agriculture of the
United States and approved by the President of the United
States by virtue of the authority conferred by the provisions of
the Migratory Bird Treaty Act, approved July 3, 1918; and no
person shall take, collect or possess any nest or egg of migratory
birds except for scientific purposes and must also obtain a per-
mit from the Game Warden of this State.

(a) It shall be unlawful to hunt any wild duck, goose, swan
or brant within the limits of the State of Maryland, between
the first day of February and the thirty-first day of October
in each and every year, both dates inclusive, and it shall
be further unlawful to have in possession any such wild duck,
goose, swan or brant between the tenth day of February and
the thirty-first day of October in each and every year, and it
shall be unlawful to hunt any of the game birds herein men-
tioned on Sunday. Provided, however, it shall be unlawful
to hunt water fowl on the Chester River and its tributaries
within the jurisdiction of Kent County during the open sea-
son, as provided herein on Tuesday, Wednesday, Thursday
and Saturday during the months of November and December,
and on Sunday during the month of January.

(b) The migratory game birds specified in this section may
be taken during the open season with a gun only, not larger
than number ten gauge, fired from the shoulder, from the land
and water, with the aid of a dog or dogs, and the use of decoys;
however, it shall be unlawful to use any air-plane, power boat,
