S68 LAWS OF MARYLAND. [CH. 301

SEC. 2. And be it further enacted, That none of the said
bonds authorized in Section 1 of this Act shall be issued ex-
cept on the following conditions:

Whenever twenty-five per centum (25%) of the taxpayers in
any Election District in Montgomery County shall petition the
County Commissioners of said county for the permanent im-
provement of any road in said district, and said petition is ac-
companied by pledges or subscriptions, in such form as may
be prescribed by the said Commissioners, agreeing to pay ten
per centum (10%) of the cost of said improvement, the said
County Commissioners shall and they are hereby directed to
issue the bonds authorized by Section 1 of this Act to an
amount sufficient to pay the balance of the cost of improving
said road not otherwise provided for, but in no event to ex-
ceed seventy-five thousand ($75, 000. ) dollars per year as pro-
vided in Section 1 of this Act, nor shall more than two miles
be constructed in any Election District in any one year under
the provisions of this Act.

The cost of constructing the permanent improved roads under
the provisions of this Act shall be paid in the following man-
ner:

(a) Ten per cent. (10%) of the cost shall be paid by the
persons making the subscriptions or pledges filed at the time
the petition is submitted to the County Commissioners.

(b) Forty per cent. (40%) of the cost shall be paid by
taxes levied on the assessable property of the Election District
in which the road is constructed or by bonds to be issued by
the County Commissioners, but the interest and principal of
such bonds to be paid from taxes to be levied on the assess-
able property of such District, or by private contributions,
or partly by all three methods.

(c) Fifty per cent. (50%) of the cost shall be paid from
the proceeds of the sale of bonds to be issued by the County
Commissioners under the provisions of Section 1 of this Act,
the interest and principal of such bonds to be paid from taxes
levied on all the assessable property of said county.

SEC. 3. And be it further enacted, That in case petitions are
filed for constructing more miles of road than can be con-
structed during any one year out of the funds which will be
available, the said County Commissioners shall give preference
to the Election District or Districts which have the least num-
ber of miles of improved roads in proportion to the assessable
property of such District or Districts, but in no case shall
