case of a tie vote, in which event the Mayor shall have the right
to vote. The Mayor shall be the executive officer of the town,
and shall have all the power and rights and authority of a jus-
tice of the peace of Prince George's County within said town
limits and shall have all the powers necessary to secure the
enforcement of any or all ordinances of said town, for the
collecting and recovering of fines, and penalties, and the com-
mitting of offenders for violations of law within the corporate
limits of said town, or of any ordinance duly passed and enact-
ed by the Mayor and Common Council of said town, and an ap-
peal from his decision and judgment in any case may be taken
to the Circuit Court for Prince George's County, which shall
hear and determine such cases as upon appeals from Justices of
the Peace; provided the person or persons aggrieved by such
decision and judgment give bond, with sureties approved by the
Mayor in double the amount of the judgment and cost against
him, within ten days from the date of such judgment.
Upon the death, resignation, or removal from the corporate
limits of said town of the said Mayor, or upon his failure to
serve, a Mayor shall be elected in the stead of such Mayor to
serve until the Mayor chosen at the next annual election shall
have qualified.
The death, resignation, conviction of the violation of any
town, county, state, or federal law, or removal from the town
limits, or failure to serve, shall ipso facto disqualify the Mayor
or any other elective or appointive official of said town.
SEC. 9. And be it further enacted, That the Common Coun-
cil of Seat Pleasant shall meet at least once a month, and the
Mayor for all purposes, except as herein noted, shall constitute
one of the council. A majority shall constitute a quorum, and
a quorum shall be necessary to transact business. If a vacancy
exists among the officers of the town or the members of the
Council, other than the Mayor, the Council shall fill the vacancy
for the unexpired term. The said Council shall be the sole
judge of the qualifications of its own members. They may pro-
vide by ordinance for contested elections, they shall have the
power to appoint one or more bailiffs, who shall have the same
authority within the town limits, now possessed by constables
of Prince George's County, as to the ordinances of said town.
The Mayor and Common Council shall have power by ordinance
to provide for the good government of the town, preservation
of peace and order therein, and for the maintenance of the good
health of the residents thereof, to establish grades of the streets.
