said meeting of the said Supervisors for the purpose of receiv-
ing such certificates of nomination, as hereinbefore provided,
except that in the event of any vacancies occurring in nomina-
tions for Mayor and Councilmen, either by declination, death
or any other cause, the same may be filed in the manner herein
provided, at any time prior to the Tuesday before the day of
any election, general or special, held hereunder. No names
shall be printed on the official ballot not presented to said
Board of Election Supervisors in the manner herein provided.
Suitable ballot boxes and polling places shall be provided by
the Mayor and Common Council. Immediately upon the closing
of the polls the ballots shall be publicly counted and the said
judges shall make a true and correct return of the votes so cast,
shall seal the same, and shall within two days thereafter return
the same to the Mayor and Common Council or the Clerk there-
of. Within ten days after said election the Mayor and Common
Council shall meet and canvas the said returns and shall declare
those persons receiving the highest number of votes for the
respective offices voted upon elected, and shall record a copy
thereof among their proceedings.

In the event of a tie vote for any office, there shall be an
election in the fourth Monday in May for the office or offices so
tied. The terms of all elective officers shall begin on the first
Monday in June next succeeding the election. The Mayor and
Councilmen shall serve for one year or until his, or their, suc-
cessor, or successors, shall have qualified.

SEC. 6. And be it further enacted, That, the said Mayor and
Common Council, at their first meeting after they shall have
been elected and qualified, shall elect a Clerk, who may or may
not be a member of the Common Council, who shall keep a
careful record of minutes and proceedings and ordinances,
which shall be open to the inspection of all persons interested
therein, and shall safely keep all records and documents, issue
licenses, collect moneys therefor, and turn same over to the
Town Treasurer. He shall also keep proper accounts as Clerk,
and shall perform such other duties as the Mayor and Common
Council may assign to him. The Mayor and Common Council
shall fix the amount and authorize the payment of the salary
of said Clerk, and the said Clerk, shall, before assuming the
duties of his office give bond for the faithful performance of
his duties as such Clerk, in such sum as may be directed by the
Mayor and Common Council. In the event of the death, resig-
nation, or removal, of said Clerk from said town, or of his fail-
