the County Commissioners of Montgomery County but not to
exceed five per cent, per annum.

SEC. 3. And be it further enacted, That the County Com-
missioners of Montgomery County, Maryland, are either
authorized to build this road in any manner and of any type
that they may see fit, or to turn the proceeds from the bond
issue created by this Act over to the State Roads Commission
to be expended by that Commission for the construction of the
road authorized in this Act.

Approved April 9, 1924.

CHAPTER 525.

AN ACT to authorize the creation of a State debt in the aggre-
gate amount of. thirty-two thousand dollars ($32, 000), the
proceeds thereof to be used for purchase of land for State
Forest, and providing generally for the issue and sale of
certificates of indebtedness evidencing such loan.

(Vetoed. )

CHAPTER 526.

AN ACT to provide for taking the testimony of witnesses in
Chancery cases orally in open Court in the presence of the
Judge or Judges thereof in Montgomery County.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That if the Circuit Court for Montgomery County in
the exercise of its sound discretion to serve the ends of justice
shall so order on application of a party in interest or of its
own motion, instead of the mode of taking testimony in Chan-
cery as provided for in Sections 252 to 260 both inclusive of
Article XVI of the Code of Public General Laws, the testi-
mony shall be taken orally in open Court before the judge or
judges thereof in the same manner and under the same rules
as testimony is now taken in actions at law, as to all or any of
the facts or matters relevant in the cause or proceeding; and
the evidence so taken shall be written down as delivered by
the witnesses by such person and in such manner as the Court
may have by order or general rule directed, and when so
written down, with such documentary proof as shall have been
with it offered and admitted, be filed as part of the proceedings.
