1080 LAWS OF MARYLAND. [CH. 410

58. The Police Justice of the town of Brunswick, who
shall also be the Justice of the Peace of Election District
Number 25, in Frederick County, or the Mayor of said
town, in the absence, sickness or other disability of said
Police Justice, shall hold his court in the municipal building
for the purpose of preserving the peace of said town and for
other municipal purposes, shall have full power and authority
to hear, determine and pass sentence in all cases for violations
of any ordinance of said town and may impose fines for such
violations, and in default of the payment of such fines and
the costs of prosecution, may imprison the offender in the
town lockup or county jail, but not exceeding one day for every
dollar of fine imposed, and not exceeding sixty days in all;
and for the purpose of carrying out the police powers herein
granted, the person, before whom any case for the violation
of an ordinance of said town shall be tried as aforesaid,
shall have the power to issue warrants commanding the chief
bailiff of said corporation, or any deputy bailiff thereof, to
arrest any person charged with violating any of the ordinances
of said town and have the offenders brought before him for
trial; he shall have the power to summon witnesses and to
enforce their attendance, both for the corporation and the
accused, by attachment as in like cases before Justices of the
Peace. But in all cases where a person is convicted of violat-
ing any ordinance of said town, and fined in excess of five
dollars, he shall have the right of appeal to the Circuit Court
for Frederick County; provided, the person appealing shall
pray the appeal forthwith, and shall give good and sufficient
bond, to be approved by the Police Justice, Mayor or other
person trying the case for the payment of the fine imposed
and all costs incurred in the prosecution and the appeal, in
case the conviction shall be sustained in the Circuit Court
aforesaid. But no appeal shall stay process or execution upon
the judgment unless a bond be given as above provided. The
person before whom any case for the violation of any ordi-
nance of said town shall be tried, shall be entitled to receive
the same fees as a Justice of the Peace would receive for sim-
ilar services.

If any offender shall be in default for the non-payment of
any fine and costs imposed, he may be proceeded against in a
civil action in the name of the Mayor and Council of Bruns-
wick in the same manner as suits are brought in this State to
recover small debts.
