of said Commission the fact of his making such appointment
and the same day notifying the person so appointed of his said
appointment. And the remaining qualified Commissioner mak-
ing such appointment shall appoint as Commissioner such per-
son who was a candidate at the last election and who received
the second greatest number of votes in the ward wherein the va-
cancy exists. If the person so appointed fails to qualify, then
the remaining qualified Commission shall appoint as such Com-
mission such person who was a candidate at the last election
and who received the third greatest number of votes in the ward
wherein the vacancy exists, and so forth. And if there be no
available candidates, from such ward wherein, vacancy exists,
who were candidates at the last election, then said remaining
qualified Commissioners may appoint any person from such
ward wherein such vacancy exists provided the person so ap-
pointed is eligible to the office of Commissioner under the pro-
visions of this Act. Any additional vacancy that may exist
shall be filled by the two qualified Commissioners by resolution,
entered in the minute books of said Commission, appointing as
Commissioner such person who was a candidate at the last elec-
tion and who received the second greatest number of votes in
the ward wherein the vacancy exists. If the person so appoint-
ed fails to qualify, the two qualified Commissioners shall, in
like manner, appoint as such Commissioner such person who
was a candidate at the last election and who received the third
greatest number of votes in the ward wherein the vacancy ex-
ists, and so forth. And if there be no available candidates,
from such wards wherein such vacancy exists, who were candi-
dates at the last election, then said two qualified Commissioners
may appoint any person from such ward wherein such vacancy
exists provided the person so appointed is eligible to the office
of Commissioner under the provisions of this Act.
SEC. 12. And be it further enacted: (A) That for the pur-
pose of determining whether the residents of the Town of Cot-
tage City desire to incorporate, there shall be held an election
in said town between the hours of 5 o'clock P. M. and 8 o'clock
P. M. on the first Monday in June in the year 1924.
(B) That J. B. MORRIS, C. A. LOCKE and P. P. GREEN-
WOOD are hereby appointed to be and constitute a Board of
Election Supervisors for the purpose of conducting such elec-
tion and declaring the result thereof.
(C) That within ten days (including Sundays and holi-
days) after this Act is approved, the persons named in para-
