August Court 1729 being impannelled and Called likewise came to wit Elias Ringgold John Earle John Cooper Thomas Massey John James Henry Trulock John Woodall Thomas Mahon Augustus Boyer John Webb Thomas Thackston John Jones who being ^duly^ Elected tryed and Sworn to Say the truth in the premises upon their Oath do Say that the afd Richard Foulston is Guilty of the theft book afd in manner and form as in the afd Information is Set forth and by Elias Ringgold their foreman all So Say And thereupon the Same was Continued until the third Tuesday in August next for to file Reasons in arrest Judgment and that the Court might Thereupon advise Att which Said next Court viz.t the third tuesday in August to wit the Nineteenth day of Same Month Anno Dom. Seventeen hundred twenty and Nine Came again the afd Lord prop.ry by the Att.ry afd And the afd Rich.d Foulston in his proper person And as Reasons being fild in the Same Cause And the Court having maturely Considered the premises Therefore it is Considered by the Court here on the third tuesday in August being the Nineteenth day of Said Month Anno Dom. Seventeen hundred and twenty Nine at the Court House in the Town of Chester in Said County That the Said Rich.d Foulston be find the Sum of One Thousand pounds of Tobacco as a fine for his offence afd according to the verdict of the Jurors afd And also pay the Sume of Thirteen hundred Ninety three pounds of Tobacco Cost Accrueing on the premises to the officers of this Court And that Josseph Young Sher of Said County keep the Same Richard in Safe Custody untill the fine and fees afd he Shall Satisfie The afd Rich.d Foulston at last June Court entered into Recognizance in the Sum of twenty pds Sterl for his appearance to this Court and Now at this Court being the third tuesday in Aug.st and the Nineteenth day of Said Month Anno Dom. Seventeen hundred twenty and Nine and here to w.ch as was found to app.r and now y.e s.d Rich.d in his prop.r person app.rd and prayd that the Same Recognizance might be discharged Ordered by the Court here that the Same Recogniz.c be Disch.d no person Shewing any Cause to the Contrary The Same is by this Court here disch.d Dan.l Ferrill being Sumoned as an Evid.c in the Same Cause proves three days attendance Ordered by the Court here that Rich.d Foulston pay him the Sume of Ninety pounds of Tob.o for the Same Joseph Butler being an Evidence in the Same Cause proves three days attendance Ordered by the Court here that Rich.d Foulston pay him the Sume of two hundred and Seventy pounds of Tobacco for the Same
Certain Richard Foulston then and there being found then and there feloniously did Steal take and bear away Contrary to the peace of the Said Lord proprietarie that now is his good Rule and Governm.t and against the form of the Act of Assembly in Such Case lately made and provided T ffrancis Cler. pac. And the Same Indictment was under writ viz.t A true Bill p Sam.l Wister foreman And the afd William Bonner in his proper person cometh and Saith that he is not guilty |
