August Court 1734 Information on the same which is as followeth viz.t Kent County fs.t Be it Remembred that Tench Francis Gent. attorney of the right honourable the Lord proprietary that now is who for the same Lord proprietarie this part prosecuteth doth come here into the County court of the same Lord proprietary held for Kent County afd to wit at Chester in the County afd the twentieth day of August Anno Domini seventeen hundred and thirty four bore James Harris Esq.r and his associates the said Lord proprietary his Justices of the same County Court and for the same Lord proprietary doth give the same Justices here to understand and be informed that Maurice Augorne late of S.t pauls parish in the County afd planter the servant of George Garnett the first day of August Anno Domini seventeen hundred thirty & four at the parish afd in the County afd within the Jurisdicion of this court in and upon James Smith of the same County in the peace of God and of the same Lord proprietary then and there being with force and Arms an assault did make and the same James then and there did beat wound and evilly treat so that of his life it was greatly despaired and other harms to him then and there did to the great damage of the same James and against the peace of the said Lord prop.ry his good rule and Government &c.a Wherefore the same attorney of the said Lord proprietarie for the same Lord proprietary prayeth the advice of the Court here in the premisses and that due process of Law in this part against the afd Maurice may be made to answer who the said Ld proprietary of and upon the premisses &c.a T francis And the afd Lord proprietary by his attorney afd prays that the afd Maurice to the Information afd may answer And the afd Maurice Aughorn in his proper person comes and Defends the force and injury when &c.a and saith that he cannot gainsay the Information afd as afd against him brought nor Can he say but that he is guilty of the assault in the Information afd exhibited and thereupon submits to the Court Therefore it is Considered by the Justices here to wit at Kent County at the Court house in he Town of Chester in said County on the third tuesday in August being the twentieth day of said Month Anno Dom. one thousand seven hundred and thirty four That the afd Maurice Aughorn be find the sum of two shillings and six pence Current money to the use of his Lordship his heirs and successors as a fine for Commiting the assault afd in form afd confest and also pay the sum of two hundred eighty seven pounds of Tobacco costs accruing on the premisses afd to the officers of this Court And the same servant being lately imported into the province thereupon the Master of the same George is to pay the fees afd to the officers of this Court and the same Maurice at the Expiration of his time of Service he pay the said Master what shall be paid for him in and upon the premisses afd Jam.s Smith Clk The Remaining part of the Courts proceedings are in Lib ________ ___________ for Crim.l business |
