November Court 1732 bodies Goods and Chattles Lands and Tenements Conditionally that if the afd Robert Wilson Shall appear and answer as afd on his Lord Ships behalf any time during this Courts Sitting and that in the mean time he is to be of good behaviour wherewith they acknowledge themselves to be therewith Content After which came the afd Robert Wilson and in his proper person Appeared and prayd he might be discharged from the afd Recognizance Ordered by the Court here that the same Recognizance be discharged as prayed The Same Robert Wilson's recognizance is by this Court here discharged there being no cause Shewn to the Contrary Nehemiah Powell and John Lovegrove their Recognizance being taken as afd for the appearance of the afd Robert Wilson Their Recog.cs as afd is by this Court here discharge Kent County fs.t The Jurors for the right honourable the Lord prop.ry that now is for the body of Kent County upon their Oath do present that Robert Wilson late of S.t Pauls Parish in the County afd Labourer the tenth day of October Anno Domini Seventeen hundred thirty & two with force and Arms at the Parish afd in the County afd within the Jurisdicion of this Court one Wallet of the Value of twenty pounds of Tobacco and two glass bottles of the Value of Six pounds of tobacco each of the goods and chattles of James Cann then and there being found then and there feloniously did Steal take and bear away contrary to the peace of the Said Lord prop.ry his good rule and Government and against the form of the Act of Assembly in Such case lately made and provided The Same was endorsed as foll. viz.t A True bill p James Moore foreman And the afd Robert being called came and in his proper person cometh and Saith that he is in no Sort guilty of the premisses above upon him Imposed as by the afd Indictment it is alledged and thereof he puteth himself upon the Country Rob.t Wilson in p.r p.ra The Clark of the Indictments informs the Court that there is not evidence to Support the afd Indictment Thereupon the Court enquires and it appears as the att.ry informs And this Court orders that a Noli prosequi be entered Therefore it is Considered by the Justices here to wit at Kent County Court House in the Town of Chester in Said County on the third tuesday in November being the twenty first day of Said Month Anno Domini Seventeen hundred and thirty two That the afd Robert Wilson as to the afd Indictment he go thereof without day and that he be therefrom Acquitted Also it is Considered that the Same Robert Wilson pay the Sum of five hundred and fifty three pounds of Tob.o costs accruing on the premisses afd to the officers of this Court Ordered |
