 Kent County fs  Memorandum that Tench Francis
Gent Attorney of the right honourable the Lord prop.ry
that it now is for the County afd who for the
Same Lord prop.ry on this part prosecuteth doth come
here into Kent County Court before William Frisby Esq.r and his associates
his Lord Ships Justices of the Same County Court to wit at Chester Town
in the County afd the day of March Anno Dom. Seventeen hundred
thirty and one and for the Same Lord prop.ry doth give the Court
here to understand and be informed that David Cole late
of S.t Pauls Parish in the County afd planter the tenth day of June Anno
Dom. Seventeen hundred thirty and one at the parish afd in the County
afd within the Jurisdicion of this Court did Commit fornication with Elizabeth
Beale of her the Same Elizabeth Beale to the high displeasure
of Almighty God to the evil Example of all others in Such case offending
contrary to the peace of the Said Lord prop.ry his good rule and governm.t
and against the form of the Act of Assembly in Such case made and provided
Wherefore the afd Attorney prayeth the Advice of the Court here
in the premisses for the Said Lord prop.ry and due process of Law against
the afd David Cole in this part to Issue to answer to the Said Lord prop.ry
of and upon the premisses &c.a

    And the afd David Cole in his proper comes And Saith that he
Cannot gainsay the Information afd So as afd against him brought nor
Said County on the third tuesday in March being the twenty first day of
Said Month Anno Dom. Seventeen hundred and thirty one  That the
afd David Cole pay the Sum of thirty Shillings Current money as afd
for Committing the offence afd in form afd Confest  Also it is Considered
by the Court here the Same day last mentioned  That the afd
David Cole pay the Sum of three hundred and one pounds of Tobacco costs
accrueing on the premisses afd to the officers of this Court
