The Humble Petition of Ellis Foukes

                    Humble Sheweth

                    That Whereas a certain Joseph Sanders being indicted
in Kent County ^Court^ in June last for Stealing three Shirts the goods of a Certain Tho.s
Hack Hutchinson of s.d County        The Said Joseph Sanders requested
yo.r Excell.cys Pet.r to be his Security for his appearance at the next
August Court held for the Said County        The Said Sanders alledgeing that
the Shirts were his own & that he took them from a hedge (least they
Should be Stole) on the plantation of the said Hutchenson there being
the body then about the Said Hutchensons House    That yo.r Excell.cy
pet.r inquiring into the affair found the truth to be as the Said Sanders
had alledged, And made no Scruple of being his Security believing that
no man could be Punished for takeing his own goods

    Yo.r Excell.cys pet.r was accordingly bound by Recognizance in the Said
Court in the Sum of 20£ Sterl for the appearance of the Said Sanders at
August Court next not doubting but the Said Sanders would have app.rd
to answer that Charge & have Saved Your humble pet.r harmless But to
your Excell.cys poor pet.r great Loss the Said Sanders runaway & did
not appear whereby yo.r poor pet.rs Recognizance was forfeited

    Yo.r pet.r therefore humble prays yo.r Excell.cy (the p.sees
Considered) That as No body has been injured & for as much as it has
already cost y.e humble pet.r a great deal of money and Since in the pursuot
of the Said Sanders (but to no effects & may be your poor pet.rs total
ruin if his Recognizance Should be prosecuted (your Excell.cy out of your
Great Clemencys Compassion will be pleased to discharged yo.r poor pet.r
from his Said Recognizance and your pet.r as in duly bound Shall pray &c.a
            The afd Pet.n was endorsed as foll viz.t

    Wee the Subscribers his Lordships Justices of Kent County do
humbly siginfie to yo.r Excell.cy that the Contents of the within pet.n

                                                                        Geo Wilson
                                                                        C hynson

    Octob.r 23.d: 1730  Intender Consideration of the within
petition and the Recomdation of the above Justices I do
