deceased, not to exceed fifty dollars; third, the debts of the de-
ceased proved or passed, as herein directed, and paid or re-
tained ; fourth the allowance for things lost or which have per-
ished without the party's fault which allowance shall be accord-
ing to the appraisement; fifth, his commissions which shall be
at the discretion of the court not under two per cent, nor ex-
ceeding ten per cent, on the first twenty thousand dollars of the
estate, and on the balance of the estate not more than two per
cent.; sixth, his allowance for costs and extraordinary expenses
(not personal), which the court may think proper to allow, laid
ont in the recovery or security of any part of the estate; and
the court may allow him credit for live stock killed for the
necessary use of the family before a sale.

SEC. 2. And be it further enacted, That this Act shall take
effect on June 1, 1922.

CHAPTER 330.

AN ACT to repeal and re.-enact, with amendments, Section 218
of Article 16, title "Chancery," of the Code of Public Gen-
eral Laws of Maryland.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That Section 218 of Article 16, title "Chancery," of the
Code of Public General Laws of Maryland, be and the same is
hereby repealed and re-enacted with amendments so that said
section shall read as follows:

218. Where any person dies, or shall have died, leav-
ing any real estate in possession, remainder or reversion, and
not leaving personal estate sufficient to pay his debts and costs
of administration, the court, on any suit instituted by any of

his creditors, may decree that all the real estate of such per-
son, or so much thereof as may be necessary, shall be sold to

pay his debts; and the funeral expenses of the decedent, to be
allowed in the discretion of the court according to the condition
and circumstances of the deceased, not to exceed three hundred
dollars, except by special order of court, and provided the
estate of the deceased be solvent, shall be considered the
debt of said decedent, and in the distribution of the proceeds
arising from any sale under this section, the claim for funeral
