the event that it be determined impracticable to so divide any
of the said road machinery or equipment for use as aforesaid
then the same shall be sold, and the proceeds divided among
said road districts according to road mileage.
. Section 283. The Board of County Commissioners shall
have power to open new roads and close old roads when they
shall deem it advisable, following the provisions of the Code
of Public General Laws relating thereto. The expense thereof
shall be charged to the road district in which said road may
be located, except when the location and opening of any new
road or roads, or the closing of an old road or roads, may
be in more than one district, then, the expense thereof shall
be charged to the road districts into which the said new roads
may run, or old roads may be closed, ratably according to the
mileage of the said roads in said district or districts.
The County Commissioners shall have the right to purchase
or lease gravel banks or stone quarries, or otherwise acquire
desirable material for road construction and repair, and shall
have the right to condemn land for such purpose or for the
purpose of widening, straightening or opening roads as land
is now or may hereafter be condemned by law. The title to all
property, real, personal or mixed, in any way used with the
road system of Prince George's County is hereby vested in the
County Commissioners, and it shall require no conveyance or
action by any other agents of the county now in existence, to
vest such title in the Board of County Commissioners. All
proceedings at law or in equity now pending against said Board
on account of roads or bridges shall be defended by the said
Board of County Commissioners. All assets (including choses
in action), and all liabilities existing in connection with the
roads and bridges of Prince George's County shall be assumed
by the Board of County Commissioners from the date of the
passage of this Act; and all further proceedings at law or in
equity relating to the roads or bridges, and the road fund of
Prince George's County, shall be by or against the said Board
of County Commissioners as the representatives of the county
for such purposes.
Section 284. The County Commissioners of Prince George's
County shall in the annual levy next succeeding the passage
of this Act, and in each annual levy thereafter, levy upon the
assessable property basis of Prince George's County not more
than thirty cents per $100. 00 of such assessable basis for the
use of the roads and bridges of said county. The County
