gomery County Jail for a period not exceeding ten days; pro-
vided that in all eases where fine is imposed under this section
the party on whom the said fine is imposed, if he feels ag-
grieved thereby, may within three days, exclusive of the date of
imposition of said tine, appeal to the Circuit Court for Mont-
gomery County from the action of the said Police Justice in
such case, and pending the hearing of said appeal, shall give
surety for his appearance in the Circuit Court aforesaid in the
sum of twice the amount of the fine so imposed, which surety
may be furnished by the deposit of the amount so named in
cash with said Justice as collateral for his appearance to prose-
cute said appeal; provided no appeal shall be allowed under
this section after payment of the fine, but deposit of each as
collateral security in double the amount, of the fine shall not
be construed to be a payment of the said fine.
SEC. 12a. Be it enacted, That the County Commissioners
of Montgomery County shall appoint some suitable person as
Clerk of the Police Court for Montgomery County at a salary
not to exceed the sum of twelve hundred dollars ($1200) per
annum, payable monthly, by the County Commissioners. That
the term of office of the Clerk of the Police Court shall be for
four (4) years, beginning- on the first Tuesday in May, in
the year 1922, and ending four (4) years from the date of his
appointment, at which time and every four (4) years there-
after the County Commissioners shall appoint some suitable
person to act as Clerk of the Police Court for said county.
That said Clerk of the Police Court before entering upon his
duties shall execute a bond to the State of Maryland in the pen-
alty of five thousand dollars ($57000) conditioned for the
faithful performance of the duties of his office and to pay over
any and all monev coming; into his hands as Clerk of said
Police Court. That said Clerk of the Police Court shall attend
said Court every day, legal holidays and Sundays excepted,
from the hours of 9 A. M. until 5 P. M., and said Clerk shall
have charge of all of the records, dockets and papers of said
Court, and said Clerk shall have the authority to administer
oaths in all matters that appertain to said Court, and said
Clerk shall keep and transcribe the records and dockets of said
Court and shall issue all of the writs of said Court in the name
of the Police Justice, and shall have the power to accept such
cash collateral and deposits of sureties for the appearance of
any defendant to appear before the Police Justice for hearing
or trial, and shall issue all witness certificates and shall re-
ceive all fines, penalties and forfeitures imposed or collected
