shall be fined a sum not exceeding five hundred dollars, or sen-
tenced to imprisonment in jail for a period not exceeding one
year, or he shall be both fined and imprisoned, in the discretion
of the Court.

46. ~No person belonging to the Organized Militia, shall be
arrested on any process except such as may be issued by mili-
tary authority, while going to, remaining at, or returning from
any place at which he may be required to attend for military
duty.

It shall be unlawful for the owner, or the owner's agent,
whatever may be the latter's designation, of any place of amuse-
ment or of recreation, otherwise opened to the general public,
admission to which is free or otherwise, to refuse admission to
or exclude from the said place of amusement or of recreation-,
any officer or enlisted men of the United States Army, Navy,
Marine Corps, Revenue Cutter Service, the Organized Militia
of this State or of any State, Territory and of the District of
Columbia, by reason of such officer or enlisted man being in
uniform, and any such owner, or agent aforesaid, who, upon
conviction before a court of criminal jurisdiction, shall be found
guilty of a violation of the provision of this section shall be
deemed and he is hereby declared to be guilty of a misde-
meanor, and shall be fined a sum not exceeding five hundred
dollars, or imprisoned for not more than six months, or both in
the discretion of the court.

47. Members of the Organized Militia ordered into the
active service of the State by proper .authority shall not be lia-
ble civilly or criminally for any act or acts done by them while
in the discharge of their duty. When a suit or proceeding shall
be commenced in any court by any person against any officer of
the Organized Militia for any act done by such officer in his
official capacity in the discharge of any duty under this Article,
or against any person acting under the authority or order of
any such officer, or by virtue of any warrant issued by him pur-
suant to the law, the court shall require the person prosecuting
or instituting the suit or proceeding to file security for the pay-
ment of costs that may be awarded to the defendant therein,
and the defendant in all cases may make a general denial and
give the special matter in evidence. In case the plaintiff shall
be non-suited, or have a verdict or judgment rendered against
him, the defendant shall recover treble costs.

48. Every member of the Organized Militia shall be exempt
from jury duty, provided he shall present certificate of his im-
