C H A P. LXXVIII,

Passed Janura-
ry 19, 1805,

A Further supplement to an act for amending, and reducing into
system, the laws and regulations concerning last wills and testa-
meats, the duties of executors, administrators and guardians, and
the rights of orphans and other representatives of deceased persons.

Register's duty
to act, &c.

BE I'T ENACTED, by the General Assembly of Maryland, That in all cases where the register of wills
has been appointed auditor for the purpose of ascertaining the sum for which judgment shall be
rendered against any executor or administrator, it shall be the duty of every register to act in virtue
of such appointment, under the penalty of fifty dollars for every such neglect; and in all cases
where a person, other than the register of wills, hath been appointed auditor as aforesaid, who has
refused or shall refuse to act, the register of wills shall be appointed auditor in the place of the per-
son refusing, and shall forthwith proceed to discharge the duties thereof, under the penalty above
mentioned; and the said register, and every other person who shall act as auditor, shall be allowed
for his trouble the same fees as the register is by law entitled to receive for the stating an account
of the same number of sides which any statement by him to be made as auditor shall contain, to be
paid by the plaintiff to such auditor, and to be allowed to such plaintiff in his costs against the exe-
cutor or administrator, as other costs are taxed against them.

CHAP. LXXIX.

Passed Janua-
ry 19, 1805.

Preamble.

An ACT authorising Solomon Holland, late collector of Montgome-
ry county, to complete his collection.

WHEREAS it is represented to this general assembly, by the petition of Solomon Holland,
late collector of Montgomery county, that from various causes therein set forth he has not
been able to complete his collection within the time limitted, and that there is still due to him, as
collector of said county, considerable sums of money, and praying that a law may pass to enable him
to collect the same; therefore,

II. BE IT ENACTED, by the General Assembly of Maryland, That the said Solomon Holland be and he
is hereby authorised to collect, by himself or deputy, until the first day of January, eighteen hun-
dred and srx, all balances clue him as collector of Montgomery comity for the year eighteen hundred
and three, in the same manner as he could or might have done within the time limitted by law, any
law to the contrary notwithstanding.

To deliver an
account, &c.


III. AND BE IT ENACTED, That it shall be the duty of the said Solomon Holland, before he pro-
ceeds to execute or distrain the property of any person or persons for taxes or public dues in virtue
of this act, to deliver to such person or persons chargeable with the same, at least thirty days pre-
vious to levying such execution or distress, an account, written in words at full length, of the
taxes demanded of him, her or them, with an affidavit annexed, if required, that he hath not re-
ceived any part thereof, nor any thing as security or satisfaction for the same, more than credit
given, to the best of his knowledge.

Books to be
lodged, &-c.

IV. AND BE IT ENACTED, That the said Solomon Holland, before he derives any benefit from or
under this act, shall lodge a copy of his collection books in the clerk's office of Montgomery county,
to be open for the inspection of all persons interested in the same.

CHAP. LXXX.

Parsed Janua-
ry 19, 1805.

An ACT extending the time for taking the bond of the sheriff of
Baltimore county.

Preamble.

WHEREAS it is provided by. an act of the general assembly, passed at November session, se-
venteen hundred and ninety-four, entitled, An act for the amendment of the law in certain
cases, that the sheriffs bonds shall be hereafter taken on some day between the eighth of October
and the first day in January in each year: And whereas Thomas Bailey, the sheriff of Baltimore
county, hath not entered into bond agreeable to the above recited act; therefore,

Time extended

&c.


II. BE IT ENACTED, by the General Assembly of Maryland, That the time for taking the bond of the
sheriff of Baltimore county be extended to the first day of February next, and that if the said she-
riff shall, at any time before or on the said first day of February next, give a bond, agreeably to the
provisions of the said recited act, the said bond shall have the same eflect, to all intents and pur-
