LXII.


ninety-nine, appointing commissioners to lay out and open a read leading from the gate of Richard
Tilghman, the fourth, near the manor road, across the country, so as to intersect the main road,
leading from I. B. to Sudler's cross roads, near Joseph Cornelius, but upon examination of the ground
it was found that a road could not be effected in the direction intended by the above law, without
great damage and expence; it is further stated in the said petition, that a road is now laid out and
opened, by consent of parties, in the best direction the nature of the ground would admit, nearly
in the direction, and near the same place, which was intended the road mentioned in the said law
should run; the petitioners pray that the said road, now laid out and opened as aforesaid, be by law
made a public road; therefore,

appointed, &c.

II. BE IT ENACTED, by the General Assembly of Maryland, That James Hall, George Godwin and
Robert Stevens, be and they are hereby appointed commissioners, to view, examine and inspect, the
aforesaid new road, and if upon examination they shall find that the said road is opened, cleared,
improved and made, a good and sufficient road, of a proper width, clear of ditches, and such as in
their opinion ought to be returned as, a public road, to be thereafter kept up at the expence of the
county, then a plot of the said road, when so made and completed as aforesaid, shall be certified,
under the hands and seals of the said commissioners, and returned to the clerk of Queen- Anne's
county court, to be recorded, and shall for ever thereafter be deemed and taken to be a public high-
way, and be repaired and improved in the same manner as other public roads in said county.

How vacancies
are to be filled.

III. AND BE IT ENACTED, That if any of the said commissioners die, resign, or refuse to ad,
the remaining commissioners are hereby authorised and empowered to appoint another person to act
in his place.

CHAP. LXIII.

Passed Janua-
ry 12, 1805.

An ACT to incorporate a company for ereding a bridge over Ches-
ter river, at Chester-town.

Preamble.

WHEREAS it is represented to this general assembly, by the petition of sundry inhabitants of
Kent and Queen-Anne's counties, that the convenience of the public would be greatly pro-
moted by erecting a bridge over Chester river, and praying that a law may pass to incorporate a
company for erecting a bridge over the said river; therefore,

II. BE IT ENACTED, by the General Assembly of Maryland,That Robert Wright, Benjamin Chambers,
Samuel Chew, William McKinney and Richard Tilghman, the 4th, of Chester-town, and James
Brown, William Chambers, Richard E. Harrison, Charles Vanderen and William B. Hackett, of
Queen- Anne's county, be and they are hereby appointed commissioners, to do and perform the seve-
ral duties herein after mentioned; that is to say, they, or a majority of them, shall and may, on or
before the first Monday of May next, procure one or more books, as they shall think necessary, and
enter therein as follows, to wit: " We, whose names are hereunto subscribed, do promise to pay to
" the president, directors and company, for erecting a bridge over Chester river, at Chester-town,
" the sum of one dollar at the time of subscribing, and four dollars in two months thereafter, for
" every share of stock in said company set opposite our respective names, and the residue thereof in
" such manner and proportions, (agreeable to the limitations hereafter expressed,) and at such times,
" as shall be determined by the president arid directors chosen in pursuance of this act ;" and shall
thereupon proceed to receive subscriptions for the stock of the said company, which is hereby de-
clared to be the sum of forty thousand dollars, divided into eight hundred shares, of fifty dollars
each, at such times and places as they shall think proper, of which six weeks notice shall be given
in the most public places in Kent and Queen-Anne's counties, and also in such news-papers on the
eastern and western shores as the said commissioners, or a majority, shall think proper, and shall
keep the said books open for the space of three weeks, unless the whole number of shares shall be
sooner subscribed for, which subscriptions may be made in person or by proxy, and in case the whole
number of shares shall not be subscribed for in that time, the said commissioners, or a majority of
them, shall give notice as aforesaid of the time and place when and where they will receive subscrip-
tions for the remaining shares.

III. AND BE IT ENACTED, That every person at the time of subscribing, shall pay to the at-
tending commissioner or commissioners one dollar for every share by him or her subscribed for, out
of which shall be defrayed the expences attending taking such subscriptions and other incidental
charges, and the remainder shall be paid over to the treasurer of the corporation, as soon as the
same shall be organised, and the officers chosen as herein after mentioned.
