1804.

hands of the commissioners aforesaid, or some one of them, for the use of the person or persons in
whose favour such valuation may be made, previous to laying out and opening the said roads as afore-
said, or either of them, as the case may be, whatever damages be as aforesaid adjudged to the party
sustaining such damages, and in case of failure of payment, or security as aforesaid, this act to be
null and void, but. in case of compliance with the provisions of this act, the said road or roads re-
spectively to be considered as public highways, and to be kept up in the same manner as other public
roads in said county.

C H A P.
XLIII.

V. AND BE IT ENACTED, That if any of the commissioners named in this act shall die, resign,
or refuse to act, the remaining commissioners, or a majority of them, shall and they are hereby au-
thorised to supply such vacancy by the appointment of another person.
CHAP. XL IV.

How vacancies
are to be filled.

An ACT authorising the selling and disposing of a small parcel of
land belonging to Stepney parish, in Somerset county.

WHEREAS it is represented to this general assembly, by the rector and vestry of Stepney pa-
rish, in Somerset county, that there is a small parcel of land lying in Salisbury, in the coun-
ty aforesaid, belonging to the said parish, which is useless and unproductive; therefore,

Preamble

II. BE IT ENACTED, by the General Assembly of Maryland, That the vestry of Stepney parish, or a
majority of them, be and they are hereby authorised and empowered to sell and dispose of all the
lands belonging to the said parish, lying in the town of Salisbury, in Somerset county, except the
church-yard, and they are hereby also empowered to convey the same to the purchaser or purchasers,
in fee-simple; and the said vestry shall have full power to appropriate the money arising from the
sale of the land aforesaid towards the repairing of the several churches in the said parish, in such
manner as they shall think most proper and beneficial.
CHAP. XLV.

Vestry may sell
lands, &c

An ACT for the relief of Joseph Booth, of Saint-Mary's county.

WHEREAS it is represented to this general assembly, by the petition of Joseph Booth, of Saint-
Mary's county, that he has for many years acted as inspector at the Leonard-town warehouse
in said county, and that he discharged his duty honestly and faithfully in that station; that some-
time in the year eighteen hundred and two, two hogsheads of tobacco were stolen out of said ware-
house : And whereas it appears unreasonable and unjust that the said Joseph Booth should be bur-
thened with the loss of the tobacco thus incurred, therefore,

Preamble

II. BE IT ENACTED, by the General Assembly of Maryland, That the justices of the levy court of
Saint-Mary's county be and they are hereby empowered and directed, at their next levy court, to
make strict inquiry into all the circumstances of the petitioner's case, and if upon such inquirj they
shall be of opinion that the said Joseph Booth has sustained any loss or damage by tobacco being
stolen out of said warehouse, and not by the negligence or inattention of the said Joseph Booth, in-
spector as aforesaid, they shall levy on the assessable property of Saint-Mary's county, a sum of
money equivalent to the quantity of tobacco so stolen, with the usual expence of collecting the same,
and the same, when collected, shall be paid to the said Joseph Booth, inspector as aforesaid.

CHAP. XL VI.

Justices to
make inquiry,
&c.

A Further additional supplement to an act, entitled, An act to erect
a town in Queen-Anne's county.

ry 12, 1805.

WHEREAS Thomas C. Earle, William Chambers, Robert Goldsborough and William Carrni-
chael, of Queen-Anne's county, by their petition to this general assembly have set forth,
that they have purchased sundry lots of land contiguous to and adjoining the town of Centre-Ville,
in Queen- Anne's county; that they are desirous of having the said lots or parcel of land annexed to,
and incorporated with, the said town, and pray that a law may pass for that purpose; and it appear-
ing to this general assembly that to extend the limits of the said town will promote the interest
thereof, as well as benefit the petitioners, therefore,

II. BE IT ENACTED, by the General Assembly of Maryland, That the commissioners of the town of
Centre-Ville, in Queen- Anne's county, or the major part of them, do, and they are hereby directed
and required, by and with the consent of the owners thereof, at any time before the first day of
June next, to cause the aforesaid lots or parcel of land to be actuallv laid out and plotted, with
