drawing of said lottery shall commence, as will satisfy the fortunate adventurers for prizes drawn by
them, and after deducting the necessary expences incurred in said lottery, shall, within twelve
months from the time of the drawing of said lottery shall commence, cause the said road to be open-
ed and cleared out in the best manner the sum of money raised by the said lottery will admit.

CHAP.
XXXVIII.

II. AND BE IT ENACTED, That it shall be the duty of said commissioners, before they act as such,
to lodge such bond in the clerk's office of Frederick county, there to be recorded, and upon such
bond, or any office copy thereof, suit or suits may be instituted against the obligors therein, or any
of them, or their or any of their legal representatives, for any breach or non-compliance with the
condition of the same

C H A P. XXXIX.

Bond to be
lodged, &c.

An ACT to compel the registers of wills in the several counties
herein mentioned to keep each his office at the seat of justice in
the county for which he shall be register.

BE IT ENACTED, by the General Assembly of Maryland, That from and after the passage of this act,
it shall be, and is hereby declared to be, the duty of the registers of wills for the time being of
the several counties herein mentioned, to wit: Saint-Mary's, Kent, Charles, Taibot, Dorchester,
Worcester, Harford, Washington and Montgomery counties, to keep each his office at the place
where the county court is held for his respective county, and there to deposite and keep all the pa-
pers belonging to his said office.

II. AND BE IT ENACTED, That it shall also be the duty of the said registers to give daily at-
tendance at their offices, either in person or by deputy, for the purpose of discharging the duties in-
cident thereto, except on Sundays, and unless prevented by sickness, or some unavoidable accident.

III. PROVIDED NEVERTHELESS, AND BE IT ENACTED, That nothing herein contained shall be con-
trued, or have effect in any manner, to authorise a deputy to transact any part of the business or
duties of the said office which is or may by law be required to be executed by the register in person,
and it is hereby declared to be the duty of the said registers, at all times after the passage of this
aCt, to attend at their respective offices, in person, unless prevented as aforesaid, at lease two days
in every week.

CHAP. XL.

Proviso.

An ACT to alter the time of holding the county court in Worcester
county.

BE IT ENACTED, by the General Asiemlly of Maryland, That for the future the county court for
Worcester county shall be held on the fourth Mondays in May and November yearly, and that
all actions, pleas, process and proceedings, which are now depending and undetermined in the said
county court, or returnable to the second Monday in February next, shall be returned, judged and
taken to be, in the same situation, state and condition, on the fourth Monday in May next, as they
would be on the second Monday in February next; and the justices of the said county court shall,
on the fourth Monday in May next, proceed to the hearing and determining of all aCtions, pleas and
proceedings, respectively, as the case, may require, as fully and effectually, to all intents, construc-
tions and purposes whatsoever, as the said, justices of the said county court could or might lawfully
do on the second Monday in February next, any law, usage or custom, to the contrary notwith-
standing.

An ACT to Incorporate the Union Insurance Company of Maryland.

WHEREAS sundry persons within this state, herein after named, have formed themselves into
a society, with a capital stock of sixty thousand dollars, for the purpose of effecting marine
insurances, and also insurances against fire and upon lives, and lending money upon bottomry and
respondentia, and transacting business relating to insurances generally : And whereas such associati-
ons have been found in all commercial countries to be highly advantageous to the community in ge-
neral, and the mercantile interest in particular; therefore,
