An ACT to dispose of the Eden school lands In Somerset county,
and for other purposes therein mentioned.

Preamble.

WHEREAS it is represented to this general assembly, that the Eden school-house, which was
erected at the joint expence of Somerset and Worcester counties, has been lately consumed
by fire, whereby the beneficial effects of its original institution have been entirely defeated : And
whereas it is further represented, that it would be advantageous to the said counties to sell the
lands belonging to the said school, and apply the money arising therefrom to the encouragement of
literature in the said counties respectively; therefore,

II. BE IT ENACTED, by the General Assembly of Maryland^ That John Done and George Handy, of
Somerset county, and John C. Handy, of Worcester county, or any two of them, in a convenient
time after the passage of this act, shall give public notice for the space of four weeks, by advertise-
ments to be inserted in some news-paper in this state, and set up in public places in Somerset and
Worcester counties, that all and singular the lands and tenements belonging to Eden school, and
heretofore vested in the visitors of the said school, lying and being in Somerset county, are intended
for public sale, at a certain time and place in Somerset county, to be mentioned in such advertise-
ments, and the said John Done, George Handy and John C. Handy, commissioners appointed for the
above purpose, or any two of them, shall attend at the time and place appointed, and shall proceed
to expose to sale, at public vendue, the whole of said lands and tenements, with the appertenances
thereunto belonging, in one lot, by the acre, or to be divided in such parcels as may be thought most
advantageous for the sale thereof, the quantity to be ascertained and laid off at the expence of the
purchaser or purchasers, and the same shall respectively be sold and struck off to the best and highest
bidder, upon the following terms; the purchaser or purchasers shall give a bond to the trustees of the
Washington academy, with good and sufficient security, lor the payment of one half part of the said
purchase money in two equal annual instalments, with interest thereon from the clay of sale, and shall
also give a bond to the visitors of Worcester county school, hereafter nominated and appointed, with
good and sufficient security, for the payment of the remaining half part of the said purchase money, in
two equal annual instalments, with interest thereon from the day of sale; the said lads and tene-
ments, from the time of such sale, shall be bound for the payment of the said purchase money, or
so much thereof as may be due, and on a compliance with the aforegoing terms of sale by any pur-
chaser or purchasers, it shall be lawful for the said commissioners, or any two of them, and they, or
any two of them, are hereby .authorised, required and empowered, to convey the said lands and te-
nements, in fee-simple, to such purchaser or purchasers as aforesaid, their heirs and assigns, subject
nevertheless to the terms and lien aforesaid; and the said commissioners are also required forthwith
to transmit and deliver the said bonds, so taken as aforesaid, to the several and respective parties to
whom the same are payable as aforesaid, within a reasonable time thereafter.

III. AND BE IT ENACTED, That the trustees of the Washington academy are hereby authorised,
empowered and required, to collect and receive the part of the said purchase money payable to them
as aforesaid, , as soon as the same shall become due, according to the said instalments, and apply the
same towards finishing and completing Washington academy, or to erect such other buildings for the
benefit of the said academy as may be deemed necessary by the said trustees, or a majority of them,
and to or for no other purposes whatever.

porated, &c.

IV. AND BE IT ENACTED, That John C. Handy, James B. Robins, Edward Henry, Joshua Duer,
John Cottingham, John Dashiell and Eben Christopher, or a majority of them, by the name of The
Visitors of Worcester County School, having first taken the usual oaths to government, and an oath
to discharge their duty as visitors of the said school, shall be and they are hereby, to all intents and
purposes, constituted and appointed a body politic, to sue and be- sued, plead and be impleaded, in
any, court of law or equity within this state; and the said visitors, and their successors, in their
corporate capacity aforesaid, are hereby authorised and empowered to collect and receive the part of
the said purchase money payable to them as aforesaid, as soon as the same shall become due, accord-
ing to the said instalments, and to apply the same to the purchase of a quantity of land, not exceed-
ing one hundred acres, in some healthy situation in the most convenient part of Worcester county,
and thereon to erect a school- house, and such other buildings as may be deemed necessary by the said
visitors, or a majority of them, and they are also, in their corporate capacity aforesaid, authorised
