1803,

trust under the government of the United States, the state of Maryland, or the corporation of the
city of Baltimore.

CHAP.
XCIII.

IX. AND BE IT ENACTED, That the first and second branch of the city council shall, in the first
week of their annual session, by their joint ballot, recommend two persons to each office now ex-
isting, or which may arise under any ordinance of the said corporation, and the mayor shall appoint
and commission one of the persons so recommended to fill the respective offices during one year, and
may also fill up all vacancies which shall happen in any office during the recess of the city council.

X. AND BE IT ENACTED, That so much of the said original act, or any supplement thereto, as
are inconsistent with, or contrary to, the provisions of this act, be and the same are hereby re-
pealed; provided nevertheless, that this act snail be assented to at the time and in the manner here-
in after directed.

XL PROVIDED ALWAYS, AND BE IT ENACTED, That nothing in this act contained shall have any
effect or operation, unless the same shall be assented to by a majority of all the members of the first
branch of the city council, after a new election of members, in the first session alter such new
election.
CHAP. XCIV.

Proviso.

An ACT annulling the marriage of Joseph Bray, of Anne-Arundel
county, and Anne his wife.

WHEREAS Joseph Bray, of Anne-Arundel county, by his petition to this general assembly
hath set forth, that his wife Anne had prostituted herself with a negro man, and was, in a
few months after her intermarriage with the said Joseph Bray, delivered of a mulatto child, and
prayed that an act might pass annulling his marriage with his said wife; and the allegations of said
petitioner being proved to the satisfaction of this general assembly, therefore,

II. BE IT ENACTED, by the General Assembly of Maryland, That the marriage of Joseph Bray, and
Anne his wife, heretofore solemnized, be, and the same is hereby declared to be, absolutely, and to
all purposes, null and void, and the said Joseph Bray, and Anne his wife, are hereby declared to be
divorced a vinculo matrimmii
CHAP. XCV.

Marriage de-
clared void, &c.

An ACT to authorise the levy court of Baltimore county to establish
two additional warehouses in the city of Baltimore for the inspec-
tion of tobacco.

Passed 7th of
January, 1804.

BE IT ENACTED, by the General Assembly of Maryland, That the justices of the levy court of Baltimore
county, or any six of them, in court sitting, be and they are hereby authorised and required,
upon application made to them, in writing, by any person or persons, to determine and fix upon two
situations, the most proper in the said city, west of Jones's Falls, on the navigable water of the
bason of the said city, and most convenient for the reception and inspection of tobacco brought by
water or land to the said warehouses, and for delivery of tobacco therefrom, for the purpose of erect-
ing and building two additional warehouses for the receipt and inspection of tobacco, and the deter-
mination of the said justices on each application, whether the same be granted or rejected, shall be
entered on the minutes of their proceedings.

II. AND BE IT ENACTED, That the person or persons whose application shall be granted and al-
lowed by the said court, shall erect and build such warehouses at his or their expence, sufficiently
large to contain and secure all the tobacco offered for inspection at the said warehouses, and shall
provide, and constantly keep in repair, at his or their expence, beams, screws, scales, weights,
brands and marking irons, and all other things necessary for inspecting all tobacco brought to the
said warehouses for inspection; and the said warehouses, when erected and finished, shall be deem-
ed public warehouses, and the proprietor or proprietors thereof may demand, and shall be entitled
to receive, one dollar, money of the United States, for each hogshead of tobacco inspected at the
said warehouses, before such hogshead shall be removed, as full compensation for the expence of
erecting the said warehouses, and keeping the same in repair, and for the providing proper beams,
screws, scales weights, brands and marking irons, and all other things necessary for inspecting to-
bacco, and for the payment of the salary or salaries to the inspector or inspectors, as the proprietor
or proprietors of the said warehouses shall agree to pay; and if any tobacco shall remain in the said
warehouses above one year afcer inspection, the proprietor or proprietors of the said warehouses
