NOVEMBER LAWS OF M A R Y L A N D,

CHAP.
LXVII.

Location re-
pealed, &c.

II. BE IT ENACTED, by the General Assembly of Maryland, That the location made any the commis-
sioners under the law to which this is an additional supplement, or under any other act supplem-
tary thereto, is hereby repealed and dectared to be null and void, and that John Partridge Nicholas
Merry man, of Elijah, Thomas Gorsuch, of Loveless, Richard Britton and George Harryman or
any three of them, are hereby appointed commissioners to examine, survey, layout and mark
road from Gravelly-hill, near the city of Baltimore, in a direction towards Liberty-town to the
Frederick county line, at or near Philemon Barne's plantation, of the width of sixty-six feet in as
streight a line as the nature of the ground will permit, running the said road by Randans' town
crossing the falls at Alien's mill, thence by Nathan Randall's tavern, on the north side thereof and
by Little's tavern, on the south side of the same; and the said commissioners are to consider not
only the distance, but the situation and goodness of the ground on which the said road is to pass/

III. AND BE IT ENACTED, That the commissioners appointed to examine, survey and lay out
the aforesaid road, after they shall lay out and mark the same, are hereby directed to return the
courses and plot thereof to the cterk of Baltimore county court, which shall be by him recorded
and the said road, when, so hid out, shall For ever afterwards be held and adjudged, in all court of
law and equity, a public road and common highway

IV. AND BE IT ENACTED, That the said commissioners so attending on the location of the said
road, shall have and receive for their services the sum of two dollars per day to each commissioner -
and the levy court of Baltimore county are hereby authorised and empowered to assess and lew the
same on the .assessable property in said county, J

C H A P, LXVIII.

An ACT authorising the city commissioners to open and extend
Water-street in the city of Baltimore.

Preamble.

WHEREAS it is represented to this general assembly, by the petition of sundry inhabitants of
the city of Baltimore, that one of the butments of Water-street bridge, over Tones's Falls
stands on part of a lot of ground belonging to Thorowgood Smith, that the safd lot is now enctosed
which renders the bridge entirely useless, except for foot passengers, to the great inconvenience
and detriment of the community, and particularly to the proprietors of houses and lots in Water
street and Ling-George-street:, in the immediate vicinity of the said bridge, and praying that a law
may pass to open and extend Water-street to the said bridge; And whereas the mayor a'nd city
council of Baltimore have, by their ordinance, bearing date the twenty-second day of March last
appropriated to this desirable object the sum of five hundred dollars, out of the funds belonging to
the city, which sum is inadequate to the purpose; therefore,

II. BE IT ENACTED, by the General Assembly of Maryland, That the city commissioners shall and
they are hereby authorised and empowered to lay out, open and extend, Water-street to the said
bridge, in a streight line drawn from the north side thereof, through Thorowgood Smith's lot and
Griffith Evans's lot, until it intersects Water-street at the south-east corner of a two story brick
house now occupied by John Stickney, and company; and the said street, when so opened and ex-
tended, and the valuation and assessment herein after directed to be made shall have taken place
shall be deemed and taken, and is hereby declared, to be a public street and highway for ever there
siter; and the said commissioners are hereby required to return a plot of the said part of Water-
street so opened and extended, to the register of the city, who shall receive and file the same as
part of the plot of the city of Baltimore, :

III. AND BE IT ENACTED, That the sheriff of Baltimore county, after having given at least ten
days previous notice in one or more of the news-papers published in the city of Baltimore, shall, at
any time before the first day of March next, summon twelve disinterested freeholders inhabitants
or the said city, to meet on the premises, who, being first sworn to assess and value what damages
shall be sustained by any person or persons whomsoever, by reason of the opening and extending
the aforesaid street, taking all benefits and inconveniencies into consideration, and also the said sum
of five hundred dollars granted to them by the corporation, shall proceed to assess and value what
damages may be sustained by any person or persons whomsoever by opening and extending the said
street, and snail also ascertain and dectare what sum of money each individual benefitted therebv
snail respectively contribute and pay towards compensating the person or persons injured by opening
and extending the said street, and the names of the person or persons, and the sums of money which
they shall respectively, be obliged to pay, shall be returned, under their hands and seals to the re-
gister of the said city, to be hied in his office; and the person or persons benefited by the opening
