CHAP.
CXIII.
On failure, &c.
treasurer to
withhold, &c.
|
IV. AND BE IT ENACTED, That on the failure of the trustees aforesaid to pay the interest or
the said sum annually, it shall be the doty of the treasurer to withhold so much of the sum hereto-
fore appropriated as an animal donation to the said school as shall be equal to the interest that may
be so unpaid; and that if the said sum of one thousand pounds shall not be repaid to the treasury of
the western shore at the time limitted by this, act, the donation aforesaid shall thereupon cease until
the said sum, and the interest thereon accruing, shall be made up out of the same, if it shall be
thought right and proper by the legislature, instead of selling the property belonging to the said
school for the purpose of repaying the sum aforesaid.

V. PROVIDED ALWAYS, AND BE IT ENACTED, That in addition to the security aforesaid, and
before the "treasurer of the western shore shall advance the aforesaid sum of one thousand pounds
current money, bond shall be given to the state of Maryland by at least three persons, to be ap-
proved of by the said treasurer, in the penal sum of two thousand pounds current money, and con-
ditioned for the payment of the said sum of one thousand pounds current money on or before the
period of ten years, to be computed from the time the same shall be advanced, and for the payment
of the legal interest annually thereon.

An ACT for the relief of Charles Hammond, of Anne-Arundel
|
|
|
Preamble.
|

WHEREAS Charles Hammond hath set forth, by his petition to this general assembly, that
William Alexander was appointed by the levy court of Anne-Arundel county collector of
the county taxes due for the year one thousand eight hundred, and that he was appointed by said
Alexander one of his deputy collectors, and that there is still due to him, as deputy collector, con-
siderable sums of money, and prayed that a law might pass authorising him to collect the same in
a speedy and summary mode f therefore,

II. BE IT ENACTED, by the General Assembly of Maryland, That the said Charles Hammond be and.
he is hereby authorised to collect all balances, left uncollected as aforesaid, at any time before the
first day of October next, in the same manner as he might have done while he was deputy col-
lector, any law to the contrary notwithstanding.

And deliver an
account. &c.
|
III. AND BE IT ENACTED, That the said Charles Hammond shall deliver to the persons charge-
able with the same, an account, written in words of full length, of the taxes demanded of them
with an annexed affidavit, if required, that the said William Alexander hath not received, nor hath
he received, any part thereof, nor any thing as security or satisfaction for the same, more than cre-
dit given, to the best of his knowledge.

lodged, &c.

IV. AND BE IT FURTHER ENACTED, That the said Charles Hammond, before he derives any
benefit from or under this act, shall lodge his collection books in the cterk's office of Anne-Arundel
county, to be open to the inspection of all persons interested in the same.

and consent

An ACT vesting certain powers in the congress of the United States
BE IT ENACTED, by the General Assembly of Maryland, That this state do hereby give and grant
their full approbation and consent, that the congress of the United States may appropriate, to-
wards the repairing, and keeping in repair, the post-roads, or any one or more of them, within this
state, such sum or sums of money as they in their wisdom may deem right, and to lay out and apply
the same to said purpose in any manner they by law may direct, and to appoint any person or per-
sons they may elect to see to the proper application of the money, according to the provisions thai
may be contained in any law they may pass for that purpose, and the person or persons appointed as
aforesaid shall have all the power, right and authority, that may be specified in said act of congress;
provided, that nothing herein contained shall extend, or be construed to extend, to authorise con-
gress to pass any law for the changing the direction of the roads, or any of them, as now establish-
ed, or to authorise them to pass a law for the opening of a new road; and provided also, that nothing
herein contained shall extend to authorise the congress of the United States to vest in any person
or persons whom they may appoint, a right to cut down or use the timber, or other materials, of any
person or persons whatever, against his, her or their consent; and provided also, that nothing here-
in contained shall vest a right in the soil of any such road, or divest any right that any person or
persons may be entitled to under any law establishing turnpike roads
