96 Kent fs Thomas Joce & Ann his wife agst William Rowles William Rawles of this County otherwise William Rawles of Kent County afores.d Inholder stands Attached to answer unto Thomas Joce & Ann his Wife Adm.rx of all & singuler y.e goods & Chattels Debts Rights & Credits of Samu.ll Tovey Inholder Deceased in A plea of trespass upon y.e Case Whereupon y.e s.d Thomas & Ann his wife Adm.rx By Griffith Jones their Attorny Comes & Complaines That Whereas y.e s.d William Rawles stood Justly Indebted unto y.e s.d Samu.ll Tovey in his life time in the sume of two thousand: two hundred forty & five pounds of Tobacco as by an Accomp.t herein Courtt Produsced maye appeare yett never the Less y.e s.d W.m the s.d sum of tobacco In the lifetime of him y.e s.d Samu.ll Did not pay: nor to y.e s.d Thomas & Ann &c In their Capacity since his Death: hath not Payed although often thereunto Required: but y.e same to pay hath Refused & still doth Release to y.e Damage of y.e s.d Thomas & Ann &c: the sum of fifteen hundred pounds of tobacco & thereupon they bring their Action And brings here in Courtt y.e Letters Testamentory by which it appears that y.e s.d Ann y.e wife of y.e s.d Thomas to be y.e Lawfull Adm.r of him the s.d Samuell Tovey Decsd [illegible] No one appearing to ans.r for y.e Defend.t Judgment awarded by default for 2245.ll tobacco & Cost
The Deft being sumoned to this cause wherefore [illegible] should not Issue ag.t her for twelve hundred sixty six pds of tobacco of y.e [illegible] of [illegible] Plumer attached in y.e heads of y.e Dft & it being made appear to this Court his [illegible] is in y.t defts hand, only seven hundred & twenty pds of tobacco w.ch this court grants Judgm.ts for to be payd out of y.e Estate of William Vaughan and Likewise Henry & Williams acknowledgeth in open Court y.t he stands indebted to y.e s.d Plumer Eight hundred pds of tobacco w.ch this court awards Judgm.t for y.e plt for y.e s.d tobacco the whole being fifteen hundred & twenty pds of tobacco Elias King Clk |
