941 Allsoe the sume of Two Hundred Forty and Seaven poundes of Tobaccoe cost of suit S Wilmer Clk Command was given to the Coroner of Kent County the 28.th day of March Anno Dom 1697 that he take Edward Sweatnam ^Ex.r of Richd Sweatnam^ if he should be found in his Bailiwick and him safe Keepe soe that he have his Body before his Maj.ties Justices att the next Court to Answer unto Edward Barrowclif of a plea the he render him 23371.ll of Tobaccoe &c.a Att which Court viz the 28.th day of February Anno Dom 1698 the day of Returne of sd Writt came Maj.r Thomas Smyth Coroner of said County and made Returne of said Writt in these words following Cepi p Tho Smyth Coroner On which said day the said Edward Sweatnam ^Ex.r as aforesd^ by Richard Macklin his Atto.ry Appeares and prayes therof to Imparle until the next Court which was granted the same day is given to the plt likewise And now here att this day viz y.e 28.th day of June Anno Dom 1698 came the sd Defd.t by his said attorney moves this Court for a Non suit for that the plt had filed no declr according to the rules of this Court which was accordingly granted Therfore it is considered by this Court that the Defend.t Edward Sweatnam ^in his sd Capacity^ doe Recover from the Plt Edward Barrowclift as well the sume of Fifty poundes of Tobaccoe for a Non suit as allsoe the sume of One Hundred Fifty and Eight poundes of Tobaccoe cost of suit S Wilmer Clk Whereas Sydrak Whittworth Griffith Jones William Pickett and Nicholas Cloudes being by this Court admitted to Practice as attornies but not giveing such Attendance as is from such person required this Court hath thought fitt to suspend and discharge them therfrom S Wilmer Clk |
