Command was therfore given to the sheerif of Kent County to cause
Twelve good and Lawfull men of his Bailiwick to come before
this Court to Try the Issue before recited which jury are viz

John Ponder
Thomas Scotton
W.m Robinson
W.m Sparkes Jun.r
 John Hues
George Smith
W.m Glanvile
John Mosse
 Thomas Punney
William Boulton
Thomas Smith
Henry Greene
Jurors

Which jury being duely sworne to Try the Issue Joyned as
before recited and haveing heard the Evidence and pleadings
on both sides the Court giveth them their charge who withdraw
to consider on the p.rmises and after some time doe returne and
being called over as allsoe the plt and defend.t doe say they
find for the Defend.t and soe they say all

Judgm.t Awarded according to verdict of the jury

Therfore it is considered by this Court that the Defend.t
Richard Wallis doe Recover from the plt Robert Davenish
as well the sume of Fifty poundes of Tobaccoe for a Non suit
as allsoe the sume of six hundred Forty and six poundes of
Tobaccoe cost of suit

                Court adjournes until to Morrow 7 of the clock

Wednesday the 29.th day of June Anno Dom 1698 same
Court sitts againe present as before

Command was given to the sheerif of Kent County the 28.th day
of April Anno Dom 1698 that he Attach any the goods Chattels
&c.a of Sam.l Withers late of sd County decead if they should be found
in his Bailiwick to the value of Three Thowsand Five hundred
poundes of Tobaccoe to sattisfie unto Rhennatus Smith &c.a and
that by good and Lawfull men &c.a soe that he she or they be and
appearere att next Court to shew cause &c.a

Att which Court viz the 28.th day of June Anno Dom 1698
the day of Returne of sd Writt came Cap.t Edward Sweatnam high
sheerif of sd County and made returne of sd Writt in these words
viz I have Attached in the hands of William Robinson of the goods
