915 Command was therfore given to the sheerif of Kent County that he cause Twelve good and Lawfull men of his Bailiwick to come before this Court to try the Issues Joyned as afore w.ch Jury are viz
Which Jury being duely sworne to Try the Issue Joyned as before recited and haveing heard the Evidence and the matter and pleadings on both sides the Court giveth them their charge who withdraw to consider on the p.rmises and after some time doe returne and being called over as allsoe the said Rich Macklin who as well &c.a and the Defend.t Daniel Toaes doe say they find for the Defend.t and soe they say all Therfore it is considered by this Court that the Defend.t Daniel Toaes be discharged from the said Informacon and goe from hence without day S Wilmer Clk Matthew Warde haveing Peticoned this Court to Practice as an Attorney and being admitted Now takes the Oathes appointed by Act of Assembly as allsoe the Oath of an Attorney Command was given to the sheerif of Kent County the 29.th day of September Anno Dom 1697 that he cause Edward Fry if he should be found in his Bailiwick to Come before his Maj.ties Justices att y.e next Court to be held for said County to Answer unto Richd Macklin who as well ^for himselfe &c.a^ informes Att which Court viz the 23.th day of November Anno Dom 1697 came Cap.t Edward Sweatnam high sheerif of said County and made returne of sd Writt in these words Cepi Edward Sweatnam sheft |
