Ricad Late of this County Deceas.d was som.d to Answer John Hinson
Hinson: Gen.t in A plea That she Render unto him y.e sume of
seven hundred & Forty & four pounds of tobacco which she from
him Unjustly Detaineth

And whereupon y.e s.d John by W.m Harris his Attorny Complaineth
& saith: that y.e s.d Benjam The Testato.r in his Life y.e twelfth Day
of July in y.e yeare of ou.r Lord God: one Thousand six hundred
eighty & Fower: by his Certaine writting granted himselfe to be
bound in y.e afores.d sum of seven hundred & forty & fouer pounds
of tobacco to him y.e s.d John: his heirs Executo.rs Adm.rs & Assignes
According to y.e tenn.r of y.e s.d writting: yett y.e s.d Benjam y.e
testato.r in his Life time & y.e afores.d Elizabeth y.e Execut.rs
of y.e testato.r afores.d hath not payed Although often there
unto Required: but the same to Render hath Demed and as yett
yett Doth Deme: to y.e Damage of the s.d John: y.e sum of one
Thousand pounds of tobacco & thereupon he bringeth his suite
And Brings here unto Courtt y.e writting afores.d w.th Debt afores.d
in forme afores.d testifieth &c whose Date is y.e Day & yeare
afores.d                        Harriss p q.r                    Jo Roc
                                                                            Rich Roc plgt

And the said Elizabeth in her pper person cometh &
Defendeth the force & Injury when & tend for plea saith
y.t the s.d John his accon ag.t her ought not to have
for y.t y.e Issuing forth the original writt she was
not admitted Ex.rx of the s.d Deceased and of this thee
demandeth Judgm.t of this Worsp.ll Court & y.e plts Late wife, Harris

This Court having Considered y.e Issue Joyned & finding &
the Letters Testamentary or y.e Deceaseds will was grant
to y.e wife before y.e plantifs originall writt Issued to his
due award Judgment for y.e plantife for Seven hundred
forty four pds of tobacco & cost of sute

Therefore it is Concidered by this Court y.t y.e s.d John
Hynson shall recover from y.e Deft out of the Estate of
y.e Deceased y.e sume of Seven hundred forty four
pounds of tobacco Debt, and cost of sute
