Benjam Recad Late of this Court y.e Deceased: was Somn.d to ans.r
unto Edward Leach Merchant in A plea that she Render unto him
y.e sum of one thousand seven hundred fifty & three pounds of tobacco
which from him she unjustly Detaineth &c

And Whereupon y.e s.d Edward by W.m Harris his Attorny Complaineth &
saith that whereas y.e afores.d Benja Recad: The testato.r in his life y.e
twenty sixth Day of May in y.e yeare of ou.r Lord God: one Thousand
Six hundred eighty & fouer: by his Certaine Writting Under the hand &
seal of him y.e s.d Benjam: Did Cause himselfe to be bound: to him y.e s.d
Edward in y.e afores.d sume of one thousand seven hundred fifty three
pounds of tobacco: or his Executo.rs Adm.rs or Assignes: as will now at Law
Appear by y.e writting afores.d yett y.e s.d Benjam y.e testtator nor Elizabeth
y.e Executo.rx afores.d sum: hath not Rendered According to y.e tenno.r of
of y.e s.d writting: But y.e same to Render hath Refused & as yett Doth
Refuse to y.e Damage of y.e Edward: the sume of two thousand pounds
of tobacco: A thereupon he brings his suite Harris p.r q.r

And how he bringeth into y.e Courtt y.e writting afores.d w.th y.e Debt
afores.d in forme Afores.d Testifieth &c whose Date is y.e Day &
yeare afores.d

And y.e s.d Elizabeth in her proper person Cometh & Defend y.e force
& Injury when &c And for plea saith: that y.e s.d Edward his action
against her ought not to have: for that at y.e time of Issuing forth
y.e Originall writt she was not Admitted Executo.rx of y.e s.d [illegible]
of this the Demander of Judgment of this worshipfull Courtt & The plt
Replyes to y.e s.d Plea: & saith: That y.e plea afores.d is not sufficient
to bar y.e s.d plt from haveing his Acction & this he praies may be [illegible]

This Courtt haveing Considered y.e Issue Joyned & finding that y.e Letter
testamentary on y.e Deceaseds will was grantted to y.e Deft [illegible]
plts originall writt Issued forth Doe Award Judgment for y.e Cost
plt for y.e sum of one thousand seven hundred fifty & three pounds of
tobacco to be payd out of the Estate of y.e Deceased & Cost of suit

Therefore it is Considered by this Courtt that y.e plt Edward Leach
shall Recover from y.e Deft out of y.e Estate of y.e Deceased one
thousand seven hundred fifty & three pounds of tobacco & Cost
of suite &c:
