Which sd cause being continued from Court to Court
until this present day

And now here att this day the said cause standing for
Tryal came the sd Richard Macklin and Informes viz

Kent fs  Be it remembred that the 23.d day of November Anno
Dom 1697 comes here into Court Richard Macklin late of
sd County Gent and exhibits here into Court his certain informacon
ag.t Isaac Caulk of sd County inholder the Tenor of
which Informacon followes in these words To the Justices of
our Lord the King for Kent County

Kent fs  Be it remembred that Richard Macklin Gent who as well for
Lord the King as for himselfe followes gives the Court aforesd to
understand and be informed that whereas by a certain Act of
Assembly made att a Gen.l Assembly hold for this Province of
Maryland the 8.th day of May att the Port of Annapolis Anno
Dom 1695 Entituled an Act for regulateing Ordinaries and
limiting the Number of them within this Province it stands
Enacted by the Authority of the same Assembly that any Ordinary
Keeper disabled or suppressed or any other person that
shall ^presume to^ Keepe Ordinary without Licence first had and obtained
except all such persons as sett up and Keepe ordinary or Ordinaries
att the port of Annapolis in Ann Arundel County shall
for every Month he or they shall Keepe Ordinary as aforsd
forfeit and pay Tenn Thowsand poundes of Tobaccoe one
halfe to their Maj.ties the other halfe to him or them that shall
sue for the same to be recovered in any Court of Record w.thin
this Province by bill plaint or Informacon wherin no Essoine ptecon
or Wayer of Law to be Allowed Yett Neverthelesse the aforesd Isaac
Caulk little regarding the Act of Assembly aforesd nor in any
manner fearing the penalty in the sd Act contained after the
Publishing the Act aforesd and before the exhibiting this Informacon
that is to say att the house of the said Isaac Caulk on the
North side of Chester River within the Jurisdicon of this Court
the first day of April Anno Dom 1697 and continually after by
the space of one whole month then next following hath
