859 On which day the sd Defend.t by Richard Macklin his Attorney appeares and prayes therof to Imparle until the Next Court which was granted the same day is given to the plt likewise Which sd cause being continued from Court to Court until this present day and now here att this day viz the 16.th day of February Anno Dom 1697 came as well the sd plt by Michael Earle his Attorney as allsoe the sd Defend.t by Richard Macklin his Attorney and the said cause standing for Tryal the Plt declares as Followeth Kent fs William Evans otherwise called William Evans late of Talbot County Blacksmith was summoned to Answer unto Thomas Bruff of a plea that he render unto him the full and just sume of quantity of Twenty Eight Bushels of Wheat or Three poundes Tenn shillings current and lawfull money of England which to him he Oweth and from him he unjustly deteineth And whereupon the sd Thomas Bruff by Michael Earle his Att.ry saith that Whereas the sd William y.e 8.th day of June Anno Dom 1693 in sd County within the Jurisdicon of this Court by his certain Writing obligatory sealed with his seale as his Act and deed delivered and here into Court brought whose date is y.e same day and Yeare did bind himselfe his Heires Ex.rs and Adm.rs in sd sume or quantity of 28 Bushels of Wheat or 3.ll 10.s unto the sd Thomas his Heires Ex.rs Adm.rs or Assignes for the paym.t of the sume of quantity of Fourteen Bushels of Wheat or One pound fifteen shillings in current & lawfull money of England att or before the tenth day of October then next Ensueing ye |
