833 Command was given to the sheerif of Kent County the 20.th day of September Anno Dom 1697 that he take James Smith otherwise &c.a if he should be found in his Bailiwick and him safe Keepe soe that he have his Body before his Maj.ties Justices att the next Court to Answer unto Perigrine Browne and Comp.a of a plea that he rend.r them &c.a Att which Court viz the 28.th day of September Anno Dom 1697 the day of Returne of sd Writt came Cap.t Edward Sweatnam high sheerif of sd County and made returne of sd Writt in these Words viz Cepi p Edward Sweatnam sheft And now here att this day the sd 28.th day of September 1697 the sd Defend.t being in Custody the sd cause is continued until next Court the same day is given to the Plt likewise And now here att this day viz the 24.th day of November Anno Dom 1697 came the sd Plts by Richard Macklin their Att.ry the sd cause standing for Tryal declareth viz
of a Plea that he render unto them the full quantity of Thirteen Thowsand Two hundred poundes of good sound M.rchantable Leafe Tobaccoe and cask which to them he Oweth and from them he unjustly deteineth And whereupon the sd plts by Richard Macklin their Att.ry complaines that whereas the sd James Smith on the first day of October Anno Dom 1696 in sd County within the Jurisdicon of this Court by his certain Bond or Writing obligatory sealed with his seale as his Act and deed delivered and here into Court brought whose date is the same day and Yeare did bind himselfe unto Perigrine Browne and Comp.a M.rch.ts in London in the full quantity of Thirteen |
