822 Did bind himselfe his Heires Ex.rs and Adm.rs to pay or cause to be paid unto the sd Edward Batthurst of London M.rcht his Heires Ex.rs Adm.rs the just sume and neat quantity of 2921.ll of Tob quallified as aforesd convenient in Kent or Cæcil County &c.a Yett Notwithstanding the sd Sam.ll the sd sume of 2921.ll of Tobaccoe according to the Ten.r of the same Bill unto the sd Edward he hath not paid alltho often demanded but the same to pay he hath denied and refused and still doth deny and refuse to the damage of the sd Edward Batthurst the sume of 5842.ll of Tobaccoe and therupon he bringeth this Action Macklin p q.r pledges &c.a Jn.o Doe Ri Roe And the sd Thomas Coursey Att.ry of the sd Defd.t comes into Court and pleades Non Sum Informatus Therfore it is considered by this Court that the Plt Edw.d Batthurst doe Recover from the Defend.t Samuel Tovey as well the sd sume of Two Thowsand Nine hundred Twenty and One poundes of Tobaccoe as allsoe the sume of Two hundred sixty and Nine poundes of Tobaccoe cost of suit S Wilmer Clk Command was given to the sheerif of Kent County the Tenth day of September Anno Dom 1697 that he take Thomas Collins if he should be found in his Bailiwick and him safe Keepe soe that he have his Body before his Maj.ties Justices att the next Court to Answer unto John Hodgins of a plea of Trespasse upon the case Att which Court viz the 28.th day of September Anno Dom 1697 the day of returne of sd Writt came Cap.t Edward Sweatnam high sheerif of said County and made returne of sd Writt in these Words viz Cepi Corpus p Edward Sweatnam sheft |
