821 Command was given to y.e sheerif of Kent County the Tenth day of September Anno Dom 1697 that he Take Sam.l Tovey if he should be found in his Bailiwick and him safe Kepe soe that he have his Body before his Maj.ties Justices att the next Court to Answer unto Edward Batthurst of a plea of Debt Att which Court viz the 28.th day of Septemb.r Anno Dom 1697 the day of Returne of sd Writt came Cap.t Edward Sweatnam high sheerif of sd County and made Returne of sd Writt in these wordes viz Cepi Edw Sweatnam sheft On which sd day the sd Defend.t by Thomas Coursey appeares and prayes thereof to imparle until next Court which was granted the same day was given to y.e Plt likewise And now here att this day viz the 24.th day of November Anno Dom.r 1697 the said cause standing for Tryal came as well the sd Plt by Richard Macklin his Atto.ry as allsoe the said Defd.t by his att.ry Declr viz
he Render him the just sume and Neat quantity of Two Thoasand Nine hundred Twenty and One poundes of good sound M.rch.table well quallified bright Tobaccoe and caske which to him he Oweth and from him he unjustly deteineth And whereupon the sd Edward by Richard Macklin his Att.ry complains that whereas the sd Sam.ll the 25.th day of March Anno Dom 1696/7 in Kent County within the Jurisdicon of this Court by his certain Bill or Writing obligatory sealed with his seale as his Act and deed delivered and here into Court brought whose date is the same day and Yeare did |
