        And whereupon the sd Rennatus Smith by Richard
Macklin his Attorney complaineth that whereas Jonathan
Akins of sd County Planter stood justly indebted to the sd Rennatus
the full and just sume of four hundred poundes of good sound
M.rchantable Tobaccoe in cask and the sd Jonathan being indebted
soe as aforesd the sd William to Witt the 10.th day of M.rch Anno
Dom 1696 in sd County within the Jurisdicon of this Court in
consideracon and att the Especial instance and request of
him the sd William that if the sd Rennatus would discharge
him the sd Jonathan of and from the sd Debt of 400.ll of
Tobaccoe and take him the sd William for the sume of 400.ll of
Tobaccoe as aforesd that then he the sd William upon himselfe
assumed and to the sd Rennatus faithfully promised that he
the sd William the sd sume of 400.ll of Tobaccoe unto the sd
Rennatus would well and truely pay when therunto required
And the sd Rennatus in fact saith that he trusting to the promise
and assumption aforesd of him the sd William did discharge him
him the sd Jonathan of and from the sd sume of Four hundred
poundes of Tobaccoe as aforesd Yett Neverthelesse the sd W.m the sd
sume of 400.ll of Tobaccoe according to his promise and Assumption
aforesd unto the sd Rennatus he hath not paid but the same to
pay he hath denied and refused and still doth deny and refuse to
the damage of him the sd Rennatus 800.ll of Tobaccoe and therupon
he brings this suit            Macklin p q.r pledges &c.a Jn.o Doe

To which the Defend.ts Attorney pleads Non sum informatus
Wherupon the Plt by Richard Macklin his Attorney prayes he
may have Judgm.t Awarded consen.t to his Declaracon which
is Accordingly Granted

Therfore it is considered by this Court that the Plt Rennatus
Smith doe Recover from the Defend.t William Sigley as Well the
sd sume of Four hundred poundes of Tobaccoe as allsoe the
sume of Two hundred Thirty and Seaven poundes of Tobaccoe
cost of suit
