Which Demurrer as aforesd bring Argued an by this Court
considered this Court doth Judge that the said Demurrer is
good in Law

Wherupon the Defend.t by Richard Macklin his Attorney moves
this Court for a Non suit which is accordingly granted

Therfore it is considered by this Court that the Defend.t Thomas
Lewis doe Recover from the Plt Thomas King as well the
sume of Fifty poundes of Tobaccoe for a Non suit as allsoe
the sume of Two hundred ~~~~~ and six poundes of Tobaccoe
cost of suit    Non suit    50

Command was given to the sheerif of Kent County the 26.th day
of March Anno Dom 1697 to take William Sigley he if he should be
found in his Bailiwick and him safe Keepe soe that he have his
Body before his Maj.ties Justices att the Next Court to be held for
sd County to Answer unto Rennatus Smith of a plea of Trespasse
upon the case

Att which Court viz the 22.th day of June Anno Dom 1697
came Cap.t Edward Sweatnam high sheerif of sd County and
made Returne of sd Writt in these words viz Cepi p me
Edw Sweatnam sheft

On which day the sd Defend.t by Griffith Jones his Attorney app.red
and prayed therof to Imparle until the Next Court which was
granted the same day is given to the plt likewise

And Now here att this day viz the 25.th day of August Anno
Dom 1697 came the sd Plt by Richard Macklin his Attorney
as allsoe the Defend.t by Griffith Jones his Attorney and the sd
cause standing for Tryal
