And now here att this day viz the 23.th day of June Anno
Dom 1697 came as well the said Thomas Bruff by Michael
Earle his Attorney as allsoe the Defend.t Thomas Leister by
Richard Macklin his Attorney and the Matter standing for Tryal
the Plt Declares viz

Kent fs  Thomas Leister otherwise called Thomas Leister
        late of Talbot County in the Province of Maryland
        Planter was summoned to Answer unto Thomas Bruff
        of the same County of a plea that he Rend.r him the
        the full and Just sume of Four hundred Ninety and Eight
        poundes of good sound M.rchantable leaf Tobaccoe and
        caske which to him he Oweth and from him he unjustly
        deteineth

And Wherupon the said Thomas Bruff by Michael Earle his
Att.ry complaineth that whereas the said Thomas Leister on the
21.th day of November Anno Dom 1694 in sd County within the
the Jurisdicon of this Court by his certain bill or Writing obligatory
sealed with his seale as his Act and deed delivered and here in Court
Brought whose date is the same day and Yeare did bind himselfe
his Heires Ex.rs and Adm.rs to pay or cause to be paid unto the said
Thomas Bruff his Heires Execut.rs Adm.rs or Assignes the said sume
of 498.ll of Tob quallified as aforesaid convenient in Wry River in the
same County att or upon the Tenth day of October next Ensueing
the date of the same Bill Yett Notwithstanding the said Thomas
Leister the sd sume of 498.ll of Tobaccoe according to the Ten.r of the
same Bill unto the said Thomas Bruff he hath not paid but the
same to pay he hath denied and refused to the damage of the sd Tho
Bruff Nine hundred poundes of Tobaccoe and therupon he brings
this suit
                                Earle p q.r pledgs &c.a Jn.o Doe Ri Roe

And the said Thomas Bruff by his Attorney aforesaid comes
into Court and Declares that the said Accon is Agreed
