the Garments aforsd he should be therunto required would pay
to him the sd William such sume of Tobaccoe as the saide William
or his Wife should reasonably deserve to have and allthough he the
said William upon the hope of the faithfull performance of the
aforesd promise and Assumption of the aforesd George afterwards
to witt such as day and Yeare aforesd did Wash mend and make
dureing the time aforesd and did reasonably deserve to have the
full and Just sume of five hundred pds of Tobaccoe and Three dayes
worke which the said Copper likewise owed which did amount to the
sume of five hundred and sixty pds of Tobaccoe Yett he aforesd
George his promise and Assumption little regarding but plotting &
fraudently intending him the sd William of the aforsd five hundred
and sixty ll. Tob craftily and subtilly to deceive and defraud and y.e
same 560.ll Tob or any p.rcel therof to him the sd William hath not
pd but the same to pay hath wholly refused and denied to the damage
of the sd William Eleaven hundred and Twenty poundes of Tobaccoe
and therupon he bringeth this suit

Plea and the sd Defend.t by W.m Hemsley his Attorney saith
that for the manifold imperfections and insufficiencies in the
sd Plt declaracon and the Matter therin contained he cannot nor by the
Law of the Land is he bound to Answer therfore for Want of a sufficient
declar &c.a he prayes Judgm.t &c.a

And teh Plt saith that the Declr is good in Law and prayes Judgm.t for
the same

All which being Argued and by this Court duely considered Judgm.t is awarded
for a Non suit

Therfore it is considered by this Court that the Defend.t George Copper doe
Recover from the Plt William Glanville as Well the sume of Fifty poundes
of Tobaccoe for a Non suit as allsoe the sume of One hundred and
seaventy poundes of Tob cost of suit
