731 good sound M.rchantable loose Tobaccoe in cask which to him he oweth and from him he unjustly deteineth &c.a And whereupon the said James Ringgold by Griffith Jones his Attorney complaineth that whereas the sd Jonathan Newton y.e 10.th day of Feb.ry Anno Dom 1695 in the sd County within the Jurisdicon of this Court by his certain bill or Writing obligatory sealed with his seale as his Act and deed delivered and here in Court brought whose date is the same day and Yeare did bind himselfe his Heires Execut.rs and Adm to pay or cause to be paid unto James Ringgold the sume of Eight hundred pds Tob qualified as aforesd in y.e sd County att or upon the Tenth day of October next Ensueing the date of the same bill Yett Notwithstanding the sd Jonathan Newton y.e sd sume of Eight hundred pds of Tobaccoe according to the Ten.r of the same Bill unto the sd James Ringgold he hath not paid alltho often demanded but the same to pay he hath denied and refused to the damage of the sd James Ringgold sixteene hundred pds of Tobacco and thereupon he brings this suit Jn.o Doe Jones p q.r pledg Ri Roe
because he saith that the sd Bill was sealed and delivered unto the sd Pln.t as an Escrow merely thro the Menace and Threats of the sd Plant for Feare of life lim or Member to be taken away or otherwaies disabled all which he is ready to Aver and prove and prayed Judgm.t Hemsley p Defend.t The Plt prayes Judgm.t because there is no such reservacon in his Bill Griff Jones The Defend.t Demurs in Law to the Plt Replicacon and prayes Judgm.t Hemsley All which being Argued and by this Court duely considered Judgm.t is Awarded for a Non suit Therfore |
