Therfore it is considered by this Court that the Plant Sarah Toaes
doe recover from y.e Defend.t Thomas Beckles as well y.e sd sume of Three
hundred poundes of Tobaccoe Debt as allsoe the sume of Two hundred
Thirty and One poundes of Tobaccoe cost of suit

Command was given to the sheerif of Kent County the 28.th day of
Jan.ry Anno Dom 1696 that he take Edward Walwin if he should be found
in his Bailiwick and him safe Keepe soe that he have his Body before
his Maj.ties Justices att the Next Court to Answer unto Simon Wilmer of a plea
of Trespasse upon the case

Att which Court viz y.e 23.th day of March Anno Dom 1696 the day of
the returne of sd Writt came Capt Edward Sweatnam high sheerif of
sd County and made returne of y.e sd Writt in these Wordes viz Cepi p

Which cause now standing for Tryal came y.e sd Simon Wilmer by W.m
Hemsley his Attorney and declareth in manner and forme following

Kent fs     Edward Walwyne of sd County Planter stands Attached to answer
                unto Simon Wilmer of a plea of Trespasse upon the case

And wherupon the sd Simon by William Hemsley his Atto.ry complaineth y.t
wheras the sd Edward Walwine on the 7.th day of November Anno Dom 1696
in sd County within the Jurisdicon of this Court stood Justly indebted unto the
sd Simon Wilmer in the full and Just sume of Three hundred sixty and Five
poundes of good sound M.rchtable Tobaccoe in caske the p.rticulers therof are here
into Court brought in consideracon therof the sd Edward upon himselfe assumed
he the sd Simon faithfully promised that he the sd Edward the sd sume
of 365.ll of Tob would well and truely pay when therunto required Yett Neverthelesse
the sd Edward the sd sume of 365.ll of Tobaccoe according to his promise and
assumption aforsd unto the sd Simon he hath not paid alltho often required but
but the sume to pay he hath denied & refused to the damage of the sd Simon 700.ll Tob
and therupon he brings this suit
