Replicacon the plt by W.m Hemsley his Attorney saith that
that y.e sd plt for any Matter in the sd Defend.t plea contained he ought
not from his Accon aforesd be precluded therfore for want of a sufficient
plea and Answer to the sd Plnt Declaracon he prayes Judgm.t &c.a

The obligacon and Bill of cost above being produced to this Court and y.e
demurrers before recited being Argued y.e Court over rule the sd demurrers
whereupon the sd John Chaires by William Hemsley his Att.ry moves this Court
that he may have Judgm.t for his sd Debt and cost which is accordingly
granted

Therfore it is considered by this Court that the plt John Chaires doe
recover from the Defend.t Thomas Collins as well the aforesd sume of
One Thowsand six hundred Fifty and Eight & a halfe poundes of Tobaccoe
as allsoe cost of suit being Four hundred Eighty and Four poundes of
Tobaccoe

appeales and Robert Smith Esq becomes security that the Defend.t Thomas
Collins shall prosecute the sd appeale and likewise to pay all cost and

be not prosecuted by the Defend.t Thomas Collins with Effert
