It being for the Ball.a of Accompts for goods and M.rchandizes
sould and to the sd James by the sd Plaints delivered in consideration
wherof the sd James upon himselfe Assumed and to
the sd plaints faithfully promised that he the sd James the
sd sume of 1585.ll Tobaccoe unto the sd Plaints would well
and truely pay when therunto required Yett Neverthelesse
the sd James the said sume of 1585.ll of Tobaccoe according
to his promise and Assumption ^aforsd^ to the sd Plaints he hath
not paid alltho he the sd James by them the sd Plan.ts to doe
the same on the 10.th day of June Anno Dom 1696 att
Chester River in sd County within the Jurisdicon of this
Court hath therunto often required but the same to pay he
hath denied and refused to the damage of the said Plan.ts
Three Thowsand poundes of Tobaccoe and therupon they
bring this suit
                    Hemsley p querentib pledg &c.a Jno Doe
                                                                      Ri Roe

And the Defend.t by Samuel Withers his Attorney comes
and defends the force and injury when &c.a and pleadeth
the benefit of a certain Act of Assembly Intitled an
Act of limitacon for Accons for avoyding suits att Law
                                    Withers

And the Court considering that y.e Accon brought did
not lie within the limitacon of the sd Act of Judgm.t is
awarded for the same

Therfore it is considered by this Court that the Plain.ts
doe Recover from the Defend.t James Weyatt as well the
aforesd sume of Fifteene hundred Eighty and Five poundes
of Tobaccoe as allso the sume of
