Anno Dom 1695 in sd County within the Jurisdicon
of this Court by his certaine bill or writing obligatory seled
sealed with his seale as his Act and deed delivered and here
into Court brought whose date is the same day and Yeare
did bind himselfe his Heires Ex.rs And Adm to pay or cause
to be paid unto the sd Renatus his Heires Ex.rs Adm or Assignes
the sd sume of 4000.ll Tobaccoe quallified as aforesd conveniently
in Chester River att or upon the 10.th day of October then
next Ensueing the date of the same bull yett Neverthelesse
the sd Samuel the sd sume of 4000.ll Tobaccoe according to
the Ten.r of the same bill unto the sd Renatus he hath not
paid alltho often demanded but the same to pay he hath
denied and refused to the damage of the said Renatus Eight
Thowsand poundes of Tobaccoe and therupon he brings this
suit

Judgm.t is by this Court Awarded for the sd sume

Therfore it is Considered by this Court that the Plantif
Renatus Smith doe Recover from the Defend.t Samuel
Withers as well the sum of Four Thowsand poundes of
Tobaccoe as allsoe the sume of One hundred Ninety &
Two poundes of Tobaccoe cost of suit

Jurisdicon of this Court stood justly indebted unto the sd Plts
in the the full and just sume of Fifteene hundred Eighty &
Five poundes of good sound M.rchtable leaf Tobaccoe
