638 It being represented to this Court that Robert ^Dunn^ hath not well cleared that part of the Road to which he is appointed as Overseer Therfore it is ordered by this Court that the Clerk order him to perform it better Matthew Warde takes the Oathes appointed by Act of parliament instead of the Oathes of Alleigence and supremacy and is sworne Deputy Clerk to Simon Wilmer for this County
Therfore it ordered by this Court that the said Writt Abase Simon Wilmer Clk
Kent fs Thomas Collins of sd County Gent stands Attached to answer to Simon Wilmer of plea of Trespasse upon the case And Wherupon the sd Simon by William Hemsley his Attorney complains that wheras John Chase of the said County planter stood justly indebted to the said Simon in the full and just sume of Nine hundred and Eighty poundes of Tobaccoe and the said John being indebted soe as aforsd the said Thomas to Witt on the Tenth day of November Anno Dom 1695 in sd County within the Jurisdicon of this Court in Consideracon and att the Especial instance and request of him the said Thomas that if he the sd Simon would cleare and discharge him the said John Chase from Eight hundred and sixty poundes of Tobaccoe part of the debt aforesaid and take him the said Thomas for the debt of 850.ll Tob that then he the said Thomas upon him selfe Assumed and to the said Simon faithfully promised that he the said Thomas the said sume of 800.ll Tob unto the said Simon would well and truely pay when therunto required and the sd Simon in fact saith that he trusting to the promise and assumption aforesd of him the sd Thomas did cleare and discharge him |
